CHICAGO ? John Stone never imagined he could be fired for wearing a necktie, but that's what happened to him on Monday

The 34-year-old father of two was fired from his job as a car salesman at a suburban Chicago car dealership for wearing a Green Bay Packers tie.

When WGNTV approached Stone's manager at Webb Chevrolet in Oak Lawn, he admitted that yes, they fired Stone for wearing the tie.

General Manager Jerry Roberts said he told Stone to take it off or they'd fire him. Stone refused.

Stone's 91-year-old grandmother, a huge Packers fan, too, died a couple of weeks ago and he says he was wearing the tie for her

Could there be a wrongful dismissal suit here ?
"General Manager Jerry Roberts said he told Stone to take it off or they'd fire him. Stone refused"

no it's not discrimination and if they're an at will employer it doesn't matter. it was most likely against their company policy and he refused to comply.

What if his manager knew he had Green Bay boxer shorts on?
Would he have to take those off too or be fired?

Harsh, but not a good way to sell cars to be honest... :2 cents:

Tom_PM 01-25-2011 12:05 PM

Terrible pussy move by a terrible butthurt showroom floor manager. IMHO of course.

RaiderCash_Dominik 01-25-2011 12:05 PM

Big payday for this Packers fan.

Discrimination does not have to be a component to have a valid wrongful
termination suit.

Buy a suit from Sears, then go sale suits at Macy's. If you get fired from Macy's
for wearing the Sears suit to work, you'd probably have a strong case since
Macy's is not even supplying your wardrobe for purposes of employment.

The car dealer ship had no policy regarding ties except requiring employees to
buy one and wear it. Maybe the manger would have hated paisleys also.

Ordering an employee to disrobe a garment that actually fully meets company policy
may not even be a legal request the should be obeyed.

Phoenix 01-25-2011 12:16 PM

the packers should get their PR team in on this..and help the guy get an awesome lawyer

lol

i personally feel that if your boss says take off a tie...you take it off...but...free country and all that

Coup 01-25-2011 12:21 PM

god damn sports fans. lol. fuck off with your stupid ties, shirts, bumperstickers,... everything.

No logos or labels allowed on any visible articles of clothing is actually common with dress codes.

So what?

What does the car dealership's dress code say?????????????

Further more some jobs require that you do wear a logo....theirs!!!!

So thanks for the meaningless generalization.

TCLGirls 01-25-2011 12:31 PM

Unless this sales man had some sort of tenure agreement (highly unlikley) then he has no case against the car dealership. They can fire employees for any reason, as long as the reason is not an illegal reason. Illegal reasons would be firing based upon race, sex, religion etc. Firing based upon attire or being a fan of a certain team is not an illegal reason...though it might be dumb.

Furthermore, a Chicago car dealership has an argument that an employee wearing a Green Bay Packers neck tie can negatively affect sales since most potential buyers would probably be Chicago area residents...and thus they have a right to fire him for refusing to remove the tie.

Sly 01-25-2011 12:32 PM

Guy was pretty stupid for not removing the tie when asked. To me, it sort of suggests that he is a pain in the ass. What else is he refusing to do? Otherwise this would just be a one day "okay get out of here" kind of deal.

We already know what the car dealership's dress code says...it says whatever the general manager says it says. The manager said the dress code does not allow Green Bay Packer ties. Employee violated it. He got fired.

Scott McD 01-25-2011 12:34 PM

If i went to buy a car here and the salesman had a Rangers tie on, i would NOT be buying any car from him, and giving him commission...

I agree 100%.

Also...

Employers should be able to let employees go for any reason they want, at any time. Just as an employee should be able to leave for any reason they want, at any time.

I was once fired from a developer position where I had no outside contact other than phone and email with clients for... having earrings... Sure I was pissed and was it justified? Absolutely not, especially considering I was putting in over 80 hours a week to get their only product on the market out the door (no exaggeration). While it sucked, I still support the right for business owners to make their own decisions. :2 cents:

beerptrol 01-25-2011 12:38 PM

He was told to take it off or they'd fire him and he refused. end of story. Last time I checked, when you're on company time you don't have the luxury of freedom of speech or expression.

LeRoy 01-25-2011 12:43 PM

Those sales jobs are a dime a dozen. Getting fired from those places.. no biggie

The fact his boss is a big bitchy baby because his poor Bears lost doesn't factor in at all? Seriously his ex-boss needs to grow the fuck up and get over it. What is he 12?

CamJack 01-25-2011 12:46 PM

Fuck the Packers. Fuck the idiot for not listening to his boss. Fuck the rotting dead grandmother. Seriously.

He works at a job where he has to look respectful, a Packers tie isn't helping him close deals or cover his salary. When in sales you need to be neutral.
His boss was right to make an example out of him. It's not about the Packers its about looking the professional part and him saying no to his boss.
I have bartended in the past and had to wear a uniform, I couldn't deviate from it.

And lastly, fuck this thread.

That asshole should move to Canada where insubordination is accepted

Or perhaps the big bitchy employee should have removed his tie when requested?

Wearing a Packers tie at a sales job in Chicago the day after they won a very big game? Yeh, that has dick cheese written all over it.

djroof 01-25-2011 12:50 PM

that sucks...

Tom_PM 01-25-2011 12:51 PM

Comply or be fired. No exceptions for dead moms, or thinking it was so absurd that it couldnt be serious.

Depends on if it was a right to work state or not.

If it was a right to work state, then they can fire you for any reason they want except age, race, sex, and so on.

Zorgman 01-25-2011 01:28 PM

Shit google staff bring their pets to work like Snakes and dogs. Wearing a tie gets you fired then you know you have a FUCKED UP boss. Why would you want to work with a dick like that.

czarina 01-25-2011 01:31 PM

is that a right to work state?

marketsmart 01-25-2011 01:33 PM

Maybe so; but why should anyone be such a sore loser about a GAME on the job?

It's still a game. These are not armies trying to keep their fans free from oppression.

its the same reason why a two party political system can keep people focused on fighting for their side instead of fighting for whats right...

people are stupid sheep for the most part and just follow the person in front of them with no conscious awareness:2 cents:

Work in the car business for a week. There is no such thing as wrongful anything.

Also, most companies in this day and age make you sign papers that basically say you can get fired for anything. They do not need to have a reason.

So thanks for the meaningless generalization.

It's only meaningless if you choose it to be. The fact of the matter is many places of employment have dress codes.

That being said, you're arent the wall I choose to bang my head against today.
