Taking down a models image
One of my girls on my facial site offered me $$ to remove her images and I'm considering it... it's a long, long story. Has anyone done this before?
Right now, I'm stuck on some kind of agreement and I need help. I'd like to have something together then give it to my attorney so he can add some stuff. What do you think? |
I'd check with a lawyer... even though you have a release, it would be extortion to ask for money to take it down. Not sure the other way around, if she's offering money.

it`s all up to you dude , you can act as you wish , you have the right not to remove the photos , but sometimes you should think about others aswell.

i've had models ask me this - I tell them my standard response. I have licence that you signed so I dont' need to take it down but I'm willing to be a nice guy and accept $10,000 U.S. paid upfront to remove it from my servers.

Just keep in mind the amount of money you will lose long term and the cost of the shoot. We had this problem with a few girls all jealous boyfriends and family issues. I generally would ask 4 grand seeing I pay them well and time in the content business in not cheap. Most of the time they yell about lawyers and boyfriends but if you explain no problem I will take it down once I have money they generally go away.
When explaining it to her let her know a few key points.. The amount of the shoot the was paid to her The amount of time it took you to shoot edit photos and video The most important factor is how much could you have made having that girl with that look on your site. I know it's sounds fucked to charge them but this is a business. Models really have to think more instead of going to the fucking coach site they should pay their rent ;) Stay Rotten just my :2 cents: |

... the problem with females 18-22 is that they don't think long-term. They think just now, "I need rent $$$, I need to make a car payment...". It's not my fault, they are stupid and gullable. This girl is lucky I'm being nice to her cause I could have been a total dick :2 cents: |
Well she offered to pay you, thats still cool. Sounds like she didnt try to come at you with a ice pick or hammer, just a polite business request. Gotta respect that at least...
I am personally willing to deal with those that treat it like a business and do not try and get all personal. If they offer me a fair price sure I will deal. If at all possible, keep her on your good side and say you will knock of x amount for each girl she sends your way that you shoot. :Graucho Often these girls know other girls and well.... |
I generally give models 48 hours past the shoot to just give me my money back and be done with it. After that I tell them ahead of the shoot that once I have started editing them but before I use them its 3 times what I have paid them. And then I explain very carefully that after that, there is nothing I can do as once I have sold the pictures its too late.
But considering its on your own site, you could always be nice and take them down - I wouldnt. The legalities are fine, you just sell her the copyright to the pictures. |
You guys are tough lol . To me its not worth the pain of grief, as long as I get my money back. Also I think if you have had a model on your site for a year no one will care if she is gone. Karma is a good thing to keep positive.

Take the image down, take her damn money and move on. |
i definitely would do it if shes offering you double what you paid her. if you dont she could bad mouth you with future potential models and they might not want to work for you, or if you take them down she might refer some friends to model for you since you were nice. the content is already used so i dont see why you wouldnt take it down, you got head from her and got to use the content for a while now just for taking it down you're getting double your refund.

The biggest problem with taking them down after they have been used is that people will have saved them, there probably on Kaaza, and on newsgroups so there is no way to totally get rid of them. So she would need to be aware of that in any contract you do for them to be removed.
I am very clear with my models that there is no way for me to take them down once they are out there, no matter how hard I tried. But I sell them to others so its a bit harder. |
Takem' down...if you live in a small town you dont want any problems. it's only one girl, and besides you woundnt want her stirring up any of trouble for you. :2 cents:

If you do take the money well it does kind of sound like extortion to someone outside the business. While technically it is not, I would sure hate to have to explain it to a conservative judge here in Indiana. If at any point in the future she decides or maybe the boyfriend finds out she paid you 2x for the pictures you might have to explain it. If you do take money the a conservative approach would be to accept what you paid her for them. If extortion/ blackmail was ever claimed the 2x what you paid her would stick out like a sore thumb. Of course if you make her really mad you run the risk of an obscenity prosecution if you are in a conservative jurisdiction. Maybe her fiance saw her pics and that's what made him hook up with her. I'd confer with him before taking the pics down...lol

Telling her she can buy the content back for what it's worth is treating her like an adult and it's a good compromise because people shouldn't be able to simply recant bad decisions, or they don't learn anything from them. I'd like to be able to return that Nehru jacket I bought back in 1968 because as soon as I bought it, I realized I'd made a bad decision.
Some models pose for fun (those are the best) and some pose out of necessity (I try to avoid those), because a lot of the latter, once they get the rent paid, would like to treat the photo session as a loan of some sort. I even had a model come back after a shoot to pick up some prints I promised her, and she asked at that point if she could have the negatives. I said, "Excuse me, let me understand this: You get paid for the shoot, you get the negatives. Remind me: What am I getting out of this transaction?" She left without the negatives. I can't take back all my contractual decisions because I don't like how they turned out for me. If we lived in a world like that, contracts wouldnt' be worth the paper they're printed on. I say, just make sure you level with a model before she signs on. Answer all of her questions, and even give her some of the information she SHOULD have asked, but didn't. I get a lot of girls who say, "I don't think anyone will see these," and I invariably disagree with her and tell her she can count on people she knows seeing them sooner or later. This usually doesn't keep them from signing on. Perhaps having posed nude will be embarrassing to some of the girls later on in life, but so can some of the stupid tattoos I see people the same age getting. We all have ghosts in our closet and things we regret having done. Quite frankly, I've worked with 160 girls and while some of the girls have stopped modeling for one reason or another, only the one girl I mentioned and another girl whose parents have flipped out over the thing, come to mind as girls who seem to have major regrets. Of course, I do fairly soft stuff compared to a lot of other photographers. Maybe that is why. |
I don't think her compensating you for removing the pictures would be in anyway extortion.You have every right to be compensated if it is reasonable. The last I heard a deal is a deal. If some lawyer hassled you I would certainly figure up what I had invested in the shoot as well the loss of future income from removing the pictures.
Definitely get it in writing that you will remove the pics from your site but are not responsible for those on Kazaa, picgalleries using stolen content, etc. I dont understand why she told him. Even if he was to come across them Iwould swear to God that wasnt me and then slap him for insuating that it was. |

Just keep it simple and avoid the bullshit.
Removing her pics won't kill your business. She offered to pay you to remove them.. that removes any suggestion of extortion.. don't even know why that term was mentioned.. It's a business.. she approached you in a business manner as mentioned earlier.. Take her up on the offer and let it be history. In a week you will have forgotten all about the issue. Sure she signed a release, but as you said.. she's young and things happen.. Just sell her the rights to the pics and make sure she signs off on releasing you from any liablilities as a result from the pics being on your site for the time that they were on.. Then if she finds those pics on other sites, it's up to her to deal with it and you're out of the picture.. |

No point in keeping images that are well passed their "See by" date. If they are not making money and she is offering to pay for them. |
