I buy a homegym, the guy who sold it crashes my car window when loading - who´s to blame?

Today I bought a used homegym and me and the seller were loading it into my car. Eventually we got it in there and the guy pushes the trunk (eh... ? on a hatchback)without noticing one of the parts touching the window. One second later the whole thing goes "bam"and the window shatters into 10k pieces.

Who is to blame?

Fat Panda 04-20-2010 03:04 PM

you . . . .

Ayla_SquareTurtle 04-20-2010 03:06 PM

Hmm. Not a fun situation.

Unless I had already warned the guy to be careful or thought he was drunk or something, I think I'd just have to suck it up and pay for it out of my own pocket. :2 cents:

bronco67 04-20-2010 03:10 PM

If it was a business you were buying from, it would be their fault no problem. If it's just some guy, then it's a whole other thing. You can't ask him to pay for it.

One time I went out for a loaf of bread, and I got a ticket for making an illegal right on red. That was the most expensive peanut butter and jelly sandwich I ever had.

u-Bob 04-20-2010 03:12 PM

the guy who sold it....

closer 04-20-2010 03:13 PM

As you were both loading, I would say 50-50

Not nessessarily, unless they have loading procedures & it is part of the job. Even then, most people that carry bags to a car for a person shall usually allow them to load the car or you can find a taxi likes to take the bags from the car & place it on the ground next to the car & like wise with packing :2 cents:

Truthfully chupachups, he was doing you a favour & I bet he feels awfull. I think maybe it is one of those things & maybe next time remember to load things into your car yourself :(

I once loaded a motor bike into the back of a van, my van, my mates bike. I was doing HIM the favour of moving it to his new address. As I closed the back, the handle bar popped the back window. I did not blame him as it was my van, my window & my fault that the wondow broke, even though I was doing him a favour :2 cents:

Next time anyone says, I can help. Accept the carry, but deny them the part of actually placing the item inside your vehicle.

It's your car it's your responsibility. End of story...

chupachups 04-20-2010 03:26 PM

It seems like he will give some discount on the product sold. Yes, I think he was uncautious but nevertheless he was helping me out. I will have pay about 200 bucks of the damages (whats that called - for the insurance?) if the insurance covers it, which it should.

Just wanted to get your opinions, its indeed a tricky situation. Thx :)

Lol, one of the most moronic statements, ever.

Tires slashed? It's your car it's your responsibility.
Car Keyed? It's your car it's your responsibility.
Car Dented? It's your car it's your responsibility.
Hit and Run? It's your car it's your responsibility.

L-Pink 04-20-2010 03:30 PM

FACT: The most exercise people get from home gyms is setting them up tearing them down and moving them.

None of those examples are close to what happened here. He was getting help from the person to load his car, he was not the victim of vandalism.

MY FACTS: I am too fucking lazy to go to the gym and I always find some excuse not to. However, a year ago I bought a treadmill and I have been walking 2-3miles daily since then. Use some will power, put on a bad soap on the box and you will make it:)

I don't know why I would even waste my time on a useless little troll, but what does vandalism have to do with this thread? In any case, you would still be responsible for all of those scenarios unless you actually caught the person doing it.

Doesn't matter if it is in good faith, or not.

You mean you can't just point the blame on anyone? Obviously.

The dude who loaded the gym and closed the hatch wasn't alone.

Slightly different situation, vandals or help. But sadly, it is, to get it fixed that is :(

Glad you have got it sorted :thumbsup & most definatly nice of the guy to waive a discount for his accidental damage.

comeplay 04-20-2010 05:18 PM

Next time load it all by yourself and see how fun it is, or use a truck when hauling shit

By myself? How fun it is? Well, if I was him I would have been kind enough to do the same for him, both regarding the money and helping. Anyway, you are probably the type of guy who have no idea about such traits :winkwink:

seeric 04-20-2010 05:40 PM

that kind of a job is not car friendly. thats a truck job.

Guy is stand up as he did not have to give you a discount.

Probably true for most people. I use my exercise bike every day when I'm watching TV. Most people get a little bit of TV time in daily, exercise then.

rogueteens 04-20-2010 06:13 PM

I blame Blair

Nicky 04-20-2010 06:20 PM

Säg till han å pröjsa självrisken. Eller åtminstone dela på den.

Adam_M 04-20-2010 06:20 PM

Why blame anyone? Fix the window and move on, shit happens!

sortie 04-20-2010 06:21 PM

You got fat on your own and that's why you needed a home gym so of
course it's your fault....fatty!

:1orglaugh

Just kidding.

It's nobody's fault; it's just life.
It's way less hassle in the long run to just fix it yourself.

I am far from a fatty nowadays;) Yes, I am not blaming him really and your last two lines are quite true.

papill0n 04-20-2010 07:44 PM

throw that shit out to judgejudy man. she gets shit sorted!

kada 04-20-2010 07:51 PM

i think u should take the blame, as he was helpin you.
But if he had any brains, he too could knock a few dollars off for you.. but you shouldnt force him to pay.
goodluck

Bird 04-20-2010 08:59 PM

Ask Larry David

Waddymelon 04-20-2010 10:52 PM

Whoever closed the hatch on the home gym and broke the window is the one at fault. Its not that fucking difficult to comprehend.

Lets put it this way: If you had closed his hatch and broke his window, it'd be your damn fault wouldnt it? You can be damn sure he would say so.

I'd go with 50/50. If I was selling someone something and it happened, I'd at least offer 50% of the money to repair. It was an accident, but you should be taking more care of your car as well, especially what is loaded into it and how.
