False rape and kidnapping charges, WoW.
After 5 years in prison, former prep football star exonerated for rape, kidnapping; Something really needs to be done to anyone falsifying charges and ruining lives.

They should have to pay the money back, she should have to serve 5x the amount of time he did and pay him $1 million for each year of his life lost.
Rape is a tricky thing though. There are some people that never see justice and there are some who use the accusation to punish. Without going into details, rape is a very sensitive subject for me. |
I just read that, too. Possible 41 years, or plead guilty and do less time. Tough choice, but I would have fought it. Article said there was no physical evidence.

She was on local LA news tonight. Unbelievable. Showed no remorse, talking heads noted she does not even grasp the wrong she did to the guy...Already they are saying the money is gone...nothing can be done.
I hope Banks gets his shot, makes it, makes a gazillion bucks then hires a couple mechanics to wax her ass. |

There was a similar case involving Marcus Dixon a while back. At the time he was a senior in high school and was a football star with a nearly 4.0 grade point average and scholarship offers from a ton of schools. He accepted one to Vanderbilt. One afternoon he had sex with a girl (she was white he was black) from his school. He was 18 and she was 3 months shy of 16. Two days later she reported that he had raped her. The story that went around was that her dad was a racist, found out she had lost her virginity to a black guy and was furious. There was a trial, but he was found innocent. However, since he was more than 2 years older than her and she was a minor he was found guilty of statutory rape and aggravated child molestation. He was sentenced to 10 years. Sometime into his sentence the state changed their sentencing guidelines, but didn't make it retroactive. Among the sentences they changed were the things he was charged with. Eventually he was able to to be released after serving about 2 years. On the positive the college honored his scholarship and he eventually ended up in the NFL. |

Had she told the truth and he not been a racist there is a good chance none of it would have happened. One of the interesting parts of the story is that while the guy was in jail the state change its sentencing guidelines, but refused to make them retroactive. They were going to force him to serve the full 10 years. Because of the way the guidelines were had he actually raped her he would have served less time because of parole and time off for good behavior. Anyway, I know they aren't the same, it is just that this case reminded me of the Dixon case. |

The fucked up thing about our justice system, which is admitted to by judges and lawyers...
If you are truly wrongfully accused, you usually refuse the plea because you're innocent and end up getting fucked in the end. Guilty people usually always take the plea offer. |
The US Judicial and LAW System has huge leaks, obviously.
Smart Lawyers have figured out how to trick and hack the system by now. |

Seems the system failed this guy. Most likely couldn't afford an attorney and was appointed a public defender. There was zero physical evidence, yet his attorney recommended he accept a plea of a 5 year sentence after he had already sat in jail for 5 years rather than risk getting an additional 41 years. I'm sure Brian just felt no one believed he was innocent at that point and was scared into accepting the plea.

Clearly this guy got screwed royally and, as someone else pointed out, there was absolutely zero physical evidence aside from the bitch's assertions. But truly horrific crimes do happen and it is oftentimes possible to prove without any shred of doubt whatsoever who the perpetrator was. I'd be cool with setting the bar for death sentences considerably higher than that required to simply convict, but, let's face it, there are some people out there who really do deserve to be put down. |
