Attorneys for Jussie Smollett said Tuesday that all criminal charges against the "Empire" actor and singer have been dropped. Smollett had been charged with falsifying a police report by claiming he was the victim of a racist and homophobic attack.

"Today all criminal charges against Jussie Smollett were dropped and his record has been wiped clean of the filing of this tragic complaint against him," Smollett's attorneys said in a statement. "Jussie was attacked by two people he was unable to identify. He was a victim. He was vilified and made to appear as a perpetraitor as a result of false and inappropriate remarks made to the public causing an inappropriate rush to judgment."

My speculation? Chicago is aware of impending federal charges and is more than willing to drop the whole shit show in their laps. Or the accomplices recanted their story ($), which would likely mean charges for them. Not sure what else it could be.

False reporting charges are local not federal.

The federal charges are for would be for the letter hoax, not filing a false police report with Chicago police. But maybe they won't charge him either. Won't know until full story comes out.

Here's what prosecutors said in a statement:

"After reviewing all of the facts and circumstances of the case, including Mr. Smollett’s volunteer service in the community and agreement to forfeit his bond to the City of Chicago, we believe this outcome is a just disposition and appropriate resolution to this case."

Kim Foxx made the decision. She has the right to do so, as the elected official with purview. She may have taken a number of factors into account, such as the public nature of the matter, the disproportionate number of felonies charged, or the fact that rapists routinely get off with 2-3 year sentences while the crime of filing a false report is technically non-violent. She also may have considered that her constituency would want her to prioritize other prosecutions. Regardless, what is done is done.

CHICAGO (WLS) -- The president of the Chicago police union has sent a letter to the Justice Department alleging that Cook County State's Attorney Kim Foxx interfered in the police investigation of "Empire" actor Jussie Smollett.

Foxx had recused herself from the case, but Kevin Graham, Fraternal Order of Police (FOP) president, said that was insufficient and wants the feds to determine whether she broke any laws.

"That recusal is wholly insufficient. In order for Ms. Foxx to properly charge and try this case, her entire office should have recused itself and a special prosecutor been appointed," Graham said in a statement.

Smollett, who faces 16 felony counts of disorderly conduct for allegedly filing a false police report, claims he was the victim of a hate crime in Chicago's Streeterville neighborhood in January. However, police say it was a hoax and that Smollett hired two brothers to carry out the fake attack.

He agreed to forfeit his bond to the city, which I believe was set at 100k. Therefore I assume the attorneys agreed that 100k would cover the costs related to investigating the Smollett case.
