Seems Askdamage does not want me asking him anything. They seem to think I should come running over to them to apolagise for calling someone using my content, knowing he did not have the license and without my consent or paying me for it's transfer, a pirate. He wasn't a customer that's for sure. :1orglaugh But me and the person concerned settled our difference of opinion, resolved the matter for free for him and we had kissed and made up. The content was never bought, a license to use the content was bought. The license is written to a person not a site, the license is not for transfer by that person. It has to be transfered by us. The original seller knew this and ignored it, the new buyer found it out when I told him and still used the content. Two points. If someone buys a license to publish or view he has to abide by the terms of the license. Otherwise a member can think he has a right to buy a membership and post the site on Torrents. Same twist on ignoring licenses. If it were the original buyers right to transfer the license how do we stop sites like Megarotic and Zango picking up legal content for cheap. The sites with our content are still up, the content is still being used and no license has been issued to the new owners. In some sort of contact with them over ICQ, it's dragging on. The original buyer was also breaking the terms of the license by using some inside the affiliates area and by selling the license. I wonder if Damage allows his members and affiliates to ignore his Terms of Service as easily as he thinks I should? |
