Also, thanks to you and posting this private information on the message boards, we have added new terms to our Terms and Conditions. Thank you for ruining our great reputation.

18. Any correspondence or actions arising from disputes under this agreement are confidential and shall not be disclosed to third parties including publication on pubic or private forums or message boards. Any unauthorized disclosure will result in account termination and forfeiture of outstanding commissions as well as appropriate legal action.
So, if you don't get any reply from them and ask for a contact on boards, they included a condition to kick you out without payments. Come on ..... that's so cheap!

PS: I guess, since I am not an affiliate of them anymore, that term does not apply to me so I am free to post.

Should I get a sig spot?

So, anyone who complains publicly about not getting paid can be blocked, if they are not already, and forfeits all money they have earned?

I would sooner do a 6 figure wire load to a new pay card system started by Chris Malick than touch anything CyberAge or David Dginger is involved with.

Fuck CyberAge.

mgtarheels 12-16-2010 08:33 PM

Just because it is in a ToS does not make it lawful.

beerptrol 12-16-2010 08:34 PM

Pretty soon they will update their TOS again
19. Any affiliate with an @ in their email addy will result in account termination and forfeiture of outstanding commissions as well as appropriate legal action.

So this affects what 6, 8 people?

faxxaff 12-16-2010 08:49 PM

Wow: http://www.gfy.com/fucking-around-and-business-discussion/1002076-semi-retired-dave-step-inside.html is a nice collection of people who also ruined CA's reputation. Why do so many people complain about them? Dave made it sound like I am the big ass.

ladida 12-16-2010 09:05 PM

Amazing how fast people go down...

Pubic forums? That clause must grab their staff by the short and curlies.

Pubic forums

You are right, David really wrote this. HAHAHAHAHAHA

moeloubani 12-16-2010 10:10 PM

I tell people if you want to have an impact, find out Dave's address and send his neighbors, family, and any work associates a letter detailing how he stole from you and warning them about him.

lazycash 12-16-2010 10:18 PM

Lol, so Cyberage deletes an affiliate's account without emailing him any explanation, doesn't let him login, doesn't send him any money he's owed and don't respond to any email inquiries as to what is going on and now they tell him that if he goes to the boards with it they'll take legal action, too funny. If they delete an affiliate's account wouldn't that no longer make him bound to the program's tos?

Dave, you brought this all on yourself by thinking you could just ignore anyone's email who had an account you decided you no longer wanted to payout on.

_Richard_ 12-16-2010 10:30 PM

i wouldn't worry too much about it.

Let me translate that for you:

18. If we don't pay you and you go and post about it to let everyone else know that we are not paying affiliates then you will have violated our TOS and therefore we wont pay you. :upsidedow:helpme

edit: I just saw the "legal action" part. What a fucking joke. We don't pay you but if you tell anyone we going to sue you.

Dave has had a serious melt down. he must be having major problems in his life. What a joke this guy turned into. Reminds me of what happened to Lars.

Kiopa_Matt 12-16-2010 10:37 PM

heh, "my customers & affiliates RUINED my company! Assholes, all of them!"

:orglaugh1

happens more often around here these days then it does on a busy freeway. :2 cents:

will76 12-16-2010 10:54 PM

and I thought the tubes ruined their business and the fact that an AVS site these days is about as relevant as a VHS tape.

Just checked CA's Alexa ranking. Hmmm, 500k. That corresponds with 3k or 4k hits a day. Not too much money in motion - even without paying affiliates.

I remember having a beeper! It was years ago, and at the time, in the UK they were very uncommon...

I wore it with pride (lol) but started getting a lot of attention from 'undesirables' who would try and make my acquaintance... Turned out that they associated the beeper with the theory that it meant I was a drug dealer !!! LOL

What's an AVS? Is that some sort of text based porn from before browsers were invented?

pornguy 12-17-2010 08:59 AM

Wow.. Just wow.. If they had a chance yesterday of getting things humming again they just blew it.
