Went to court and Epassporte agreed to pay out the funds
If you have been following my threads, I have been working with [email protected]
He has been to court today and has a sealed and stamped agreement through the court. I could not be happier and do see an end to all of this. Epass has confirmed in court they have stopped making payments. Email [email protected] it is worth the 20%. THIS FEE IS NOT PAID UNTIL COLLECTED FROM EPASSPORTE! Remember it is the holidays, expect a slower response then normal. I usually had email replies within the hour. If I can answer any questions here I will |
I wouldn't be so sure you will get the $$ just yet... but hopefully you will, congrats :thumbsup
|
Congratulations!
|
good job.
~Ray |
congrats, if this is true.
But i would have keep it quiet until money is really in my pocket... |
I was told I could speak about it. not sure what the court will do if they violate the signed agreement made there today.
The admissions they made there are serious |
very interesting, did epass say they are broke and all account holders money is gone?
|
What is minimum?
|
good news! but how long will it take them to pay the money?
here in the US, i can sue someone in California and they have to pay the amount by the court, but it is up to me to get the money from them, while other states will put a freeze on your pay checks or earnings. |
that entire scam infested island can sink and everyone on it can get fucked by giant squids
i mean...congrats |
boss, they do have a decent amount to pay, but it is within reason
|
seeandsee, I am not sure there is. Email Daniel and ask
|
what are the admissions?
|
mainly the one that I know I can talk about is that they have not paid a dime back to anyone
|
you did not appear or did you?

- SHAP? - Ianian? - TonySoprano? ..etc etc People who say they were paid.. |
Those are either virtual visa, or wallet prior to them closing out everything. They were sending out wires here and there before they closed the website where you can see your balance.

best of luck to everyone trying to recover the funds :thumbsup

For real... what the hell is the problem with Paypal... there is huge money in this... and sponsors are paying - OUT.... Not customers in.... so I don't see the risk
|
How much did you guys have to pay up front? or is it all based on %?
|
So you have a judgement in hand agaisnt epassporte? I hope you get your money but enforcing a judgment like this, well it could cost more than getting the judgement in the first place. Really need the court docs if this is true.
|
Hmmm, did you pay the attorney 25% at time of judgement entry or does he get paid when epassporte pays you? This is the million dollar question.
|
Is there a case or docket number?
|
Yeah, a judgment in hand ... even a consent judgment ... is not necessarily worth all that much. It's just another promise to pay. It's only enforceable if Epass has discoverable assets within the jurisdiction of the court, and I got no fuckin' idea if that might be the case or not.
|
Have fun actually collecting.

It is enforceable in the USA under the provisions of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards, implemented by Title 9 of the United States Code Chapter 2 (§§ 201-208 inclusive) as well as local civil codes of entitled Recognition of Foreign Country Money Judgments. Whew! yes all that. From earlier posts the Judgement included 24-7 Commercial Marketing in California. Hope it includes Oxymoron Entertainment as defendant. |
I'll fly to the USA and break Mallick's knees with a bat for 50k.
On serious note, congrats on following through to get your money. You are in a group of less than 1% in this business. Hope you can collect. Got a case number? Would like to find out about their admissions. |

Was the big Epass boss in court today? in person?

WE own a brick and motor business and got a judgement against someone who had a unpaid bill of 3000usd. We won 6 moths later i still do not have a dime of my money.

Alot of negative bullshit going on. Every time someone post some good news a few people come along and shit all over it. |
Congratulations with collecting funds from Epassporte.
|
Interesting... But yeah... Actually enforcing the judgement is a whole other deal... Especially when the corp/LLC was dissolved.
|
Congrats on getting the judgment. I just hope you're actually able to collect your money.
|
"agreed to pay". They should pay. Its not their money.
|
good thread...
hopefully some people will get their cash back thisway... |

They usually start their investigation a few days to a week from when they payments were sent- so for affiliates who don't carry a balance in their paypal and may have started withdrawing or otherwise spending their money, the funds aren't just frozen but they wind up with a negative paypal account balance. This pretty much locks down your account until the investigation is complete and the funds re released. I've done paypal payments for a few different programs over the years and I've only had it happen a handful of times, paypal has never confiscated funds and has always unlocked all the cash in about a week's time, give or take. In a nutshell that's the problem with paypal. 99% of the time it's fine, you just have to decide if you're willing to deal with the occasional hassle and risk that can come with it. Right now CashX seems to be the most solid since they are FDIC insured, it's something you're not getting with the majority of payment solution providers. :2 cents: |
Getting the judgement is the easiest part.
As already said by others collecting is the hard part. You will need to get things set in motion, the courts don't. The absolute easiest way is to find a debt collection business and let them handle it as they know the quickest routes to garnish wages etc... Even then you may still never see your money. We have one debt we have been working on getting collected now for over 3 years, we have a judgement and a collection guy as well. Still no dice, guy owns nothing and his boss has started just paying him on the side and swears he isn't an employee. Good Luck to you |

You could find some crackheads around here to do that for a few hundred dollars ... |

The world is full of people with worthless judgments. I'm not saying this is one of them -- I don't have a clue -- I'm just saying celebration is premature until money is in hand. Somebody agreeing to entry of judgment against them for money of yours that they already owed you and already weren't paying and never seriously claimed they didn't owe you? Not a huge legal victory. |
Did he send you copies of the court documents?
I have a hard time to believe that somebody from epass flew over to some island to sign your court papers. |
Yeah, will go back to court if the judgement is not paid. I guess I need to ask if that means Mallick himself in the US if its not paid.
