If you have been following my threads, I have been working with [email protected]

He has been to court today and has a sealed and stamped agreement through the court. I could not be happier and do see an end to all of this.

Epass has confirmed in court they have stopped making payments.

Email [email protected] it is worth the 20%.
THIS FEE IS NOT PAID UNTIL COLLECTED FROM EPASSPORTE!

Remember it is the holidays, expect a slower response then normal. I usually had email replies within the hour.

here in the US, i can sue someone in California and they have to pay the amount by the court, but it is up to me to get the money from them, while other states will put a freeze on your pay checks or earnings.

Those are either virtual visa, or wallet prior to them closing out everything. They were sending out wires here and there before they closed the website where you can see your balance.

Yeah, a judgment in hand ... even a consent judgment ... is not necessarily worth all that much. It's just another promise to pay. It's only enforceable if Epass has discoverable assets within the jurisdiction of the court, and I got no fuckin' idea if that might be the case or not.

Read his posts! You pay them their fee once the money has been recovered.

It is enforceable in the USA under the provisions of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards, implemented by Title 9 of the United States Code Chapter 2 (§§ 201-208 inclusive) as well as local civil codes of entitled Recognition of Foreign Country Money Judgments.


Whew! yes all that.
From earlier posts the Judgement included 24-7 Commercial Marketing in California.

Hope it includes Oxymoron Entertainment as defendant.

The only time I sued someone the insurance company cut the check to my lawyer and the lawyer took his fee. I dont know if that is normal or not, but thats my one experience.

The problem with paypal is this- if you move serious bucks overseas your account gets flagged and occasionally paypal will do an investigation. While under investigation paypal can, and in my experience will, freeze all the funds sent for the last pay period; not just one or two, not just international, but everyone.

They usually start their investigation a few days to a week from when they payments were sent- so for affiliates who don't carry a balance in their paypal and may have started withdrawing or otherwise spending their money, the funds aren't just frozen but they wind up with a negative paypal account balance. This pretty much locks down your account until the investigation is complete and the funds re released.

In a nutshell that's the problem with paypal. 99% of the time it's fine, you just have to decide if you're willing to deal with the occasional hassle and risk that can come with it.

Right now CashX seems to be the most solid since they are FDIC insured, it's something you're not getting with the majority of payment solution providers. :2 cents:

Getting the judgement is the easiest part.
As already said by others collecting is the hard part.
You will need to get things set in motion, the courts don't.
The absolute easiest way is to find a debt collection business and let them handle it as they know the quickest routes to garnish wages etc...
Even then you may still never see your money.
We have one debt we have been working on getting collected now for over 3 years, we have a judgement and a collection guy as well. Still no dice, guy owns nothing and his boss has started just paying him on the side and swears he isn't an employee.

On the serious side, I would think it easy to get a judgment as there is no affirmative defense to absconding with monies entrusted to ePassporte. However, attaching assets to ensure payment is another story. Actually, why ePassporte has not declared bankruptcy befuddles me — maybe they still have substantial undiscovered assets?

As for us, we recovered all of our wallet monies mid September — I realize that we were more fortunate that most ...

No duh, but none of that means squat unless the judgment defendant has assets you can find and attach.

The world is full of people with worthless judgments. I'm not saying this is one of them -- I don't have a clue -- I'm just saying celebration is premature until money is in hand. Somebody agreeing to entry of judgment against them for money of yours that they already owed you and already weren't paying and never seriously claimed they didn't owe you? Not a huge legal victory.

I have a hard time to believe that somebody from epass flew over to some island to sign your court papers.

Yeah, will go back to court if the judgement is not paid. I guess I need to ask if that means Mallick himself in the US if its not paid.
