"Finally, Moe asks: if a site links and embeds to all the same content, but does not profit from it (i.e., does not have advertising), is it criminal? Hayes totally punts and says he'd have to check the law. Yes, really. So the guy is not an expert on the technology and admits he's not an expert on the law in question. So what is he an expert in and why is he leading these questionable seizures? "

google profits directly from torrents

try a search for "gfrevenge"

ads on top , many torrents in top 10

infact it is almost blackmail, if gfrevenge or an affiliate doesn't buy the adspot , the majority of the top sites would be torrent sites.

For what I've read and based on former legal cases affecting Google, it's my understanding that the difference is Google links to EVERYBODY by automatically crawling sites, which makes impossible not to link to questionable/illegal sites, while the sites seized ONLY LINK TO ILLEGAL SITES and there's a human effort to do that. In other words: Google may fail at filtering the illegal sites between billions of sites while the other domains have an illegal purpose by definition

I didn't think it by myself, Google and Yahoo uses this argument every single time they're taken to court. Sometimes they lose, but most of the times they have won
