F*cking Tube site removed our watermark and replaced with their own!
 
Hi there,

The tube site is b e l l a p o r n .com/video/123/lesbians-playing-with-anal-beads-closeup
(this is just one example, there are some other videos and we?re still trying to figure out how many of our vids have been stolen).
As you can see, they have removed the 18closeup.com logo from several videos and replaced with their own watermark. Has anyone dealt with some this type of copyright theft? Any advise of what would be the best way to deal with this issue?

Thanks for the tip. What should we ask to the host? We could send them a copy of the Copyrighted Material Violation notification but it would probably be more efficient if they're pressurized by some potential legal actions... As a host, where is their responsability?

Here is what tubes usually do to limit their liability. A user (or an alleged user, sometimes owners of the tube will do it themselves) upload footage to a site. As long as their is not a watermark whoever made it can claim they produced it. They check mark some 2257 and releases and it awaits approval.

This has been discussed many times. Contact the host and say for them to ban your content. Of course this is hard if the watermark is gone.

I can totally see the admins uploading a modified video of yours and then watermarking it but you never know, better to warn them first and then take legal action if it continues.

Use larger, randomly moving watermarks.

They can't crop or cover them all. If they are going to steal it, at least also get your URL or brand on there.

Anyone who is still using one silly little watermark in a single corner is going to lose. Think outside the box and beat them at their own game. There are a few different things you can do to beat this.

Well, I'm not sure my members would like to have large and moving watermarks on their porn ! It's like shooting in your own foot ;)

Another good idea is to have one main watermark in one of the corners of the vid and several small transparent watermarks throughout the video. The key is to make them transparent enough so the viewer can still see the vid, but non-transparent enough for the watermark to show, if that makes any sense

I have same problem with bellaporn but they upload it also to other tubes, takes almost 2 weeks to delete all.

Hey rogueteens, sorry for the late answer.

I had a case where some sponsor had a video which he called "his own" and it was in his tube export tool. So i thought i MAY use this video. Weeks later got an DMCA whatever and i removed that video. So, what i want to say: There ARE Webmasters out there which really care. :(

I usually google our name or url combined with "rar" to find stolen stuff. Emailed Rapidshare 2 days ago about some full lengths, and the links are already down. It's still just a pain in the arse having to do all this.

Good idea on the watermark (as long as it's not constantly moving around the screen like a fly!) How about beginning with a full frame watermark or website url and also ending with it. Maybe even throw in a black screen with ur website in the middle of the clip if u can find an appropriate cut!

If people are going to rip our content (and they will) let's just make sure it advertises well ;)

on the other hand you can not do that unless you have registered your video patent office when, how are you going to prove otherwise it is your video and you do not have it sold or offered himself ?! Next time be smarter and place your own watermark on the video..

I've uploaded videos for a client about 2 years back using TSS and some producer accounts with the tubes. From what I've read in their TOS, all videos you upload becomes their property... did you read something like that before you started uploading?

Don't Always Assume the Worst
 
I think you should always contact the webmaster first. On tube sites you see a lot of the same content reposted and reposted with different watermarks, branding etc.

I know no one wants to hear this, but occasionally the webmaster may just not know. For example, I just recently found out I was using a nulled theme on thepornkingdom.com while posting on here. I didn't know that meant that someone "stole" it and I guess figured out a way to trick WP into thinking it's a good registration key. I contacted the owner of the theme, paid him and we are all good.

Some asshole might say "what did you think it meant"? I am a webmaster and I write thousands of lines of code, write blog posts, etc. A lot of times everyone gets caught up in their own shit and things are overlooked. Well, I download from themes and templates all the time and they're legit.
