Apple Sends MiKandi Cease-and-Desist Over 'App Store' Term
Apple sent adult app supplier MiKandi a cease-and-desist order asking the company to stop using the term ?app store.?
Mikandi had dubbed itself as ?the world?s first app store for adults? but has since replaced any references to ?app store? with ?app market.? This week, Apple also hit Amazon with a suit over its use of the term ?Appstore,? which Amazon launched this week anyway. ?Our pockets aren?t as deep as Amazon?s, so today, we?re introducing you to MiKandi ? the world?s first app market for adults,? MiKandi said in its blog. ?While it?s not worth it for us to fight Apple?s legal team over this by ourselves, perhaps we can file an amicus brief to Microsoft?s case.? Microsoft is currently in court over Apple's "app store" trademark.
Any settlement or court order will have wide reaching precedent on so called "generic trademarks." |
"app. store" should be fine since "app." is clearly short for application, whereas "app" may not be.
