What concerns me most is not what stupid thing AFF is doing but that Facebook may be successful in their suit against some AFF affiliates and the horrible ramifications that could cause once that precedent has been set.

I don't think AFF are being necessarily stupid, I'd be pretty sure they have been posturing with this for some kind of eventual settlement that benefits rather than hurts them.

Once companies start throwing lawsuits at eachother the whole process becomes muddied with claim and counterclaim leading to the most common outcome, which is an out of court settlement.

I wouldn't like to predict the outcome.

It's just a play to get the domain taken away. They will get it and that should be the end of it. I doubt they can do anything to affiliates for promoting, they aren't breaking the law.

I think they have a valid case against their affiliates, their affiliates are profiting off of it as well. Don't be surprised the hammer comes down on their affiliates too. "breaking the law" this isn't a criminal case, it's civil. People can be sued for anything, and in this situation FB does have a valid case to go after affiliates too. Will be interesting to see how it all plays out.
