subject facebookpornhub.com - Notice of Facebook Trademark Infringement
mailed-by markmonitor.com

hide details 02:00 (8 minutes ago)

To Whom It May Concern,

We are writing concerning your registration and use of the domain name facebookpornhub.com, which contains the famous Facebook trademark.

As you undoubtedly know, Facebook is the leading online social network service. Facebook adopted the name and trademark Facebook in February 2004 and, since that time, Facebook has actively used the Facebook name and trademark in connection with its online social network service, including maintaining the web site www.Facebook.com. The term Facebook is one of the most famous trademarks on the Internet. Facebook owns exclusive trademark rights to the Facebook name in the United States and internationally, including related common law rights. Accordingly, Facebook enjoys broad trademark rights in its name.

Facebook has made a substantial investment in developing and providing its services. As a result of Facebook?s pioneering efforts and devoting substantial effort and resources to providing only high quality services, the Facebook name and trademarks are widely known among the consuming public worldwide, and the name and trademarks embody substantial and valuable goodwill.

Accordingly, we were concerned when we learned of your registration and use of facebookpornhub.com. As we hope you can appreciate, protection of its trademarks is very important to Facebook. Your registration and use of facebookpornhub.com violates the Lanham Act (15 U.S.C. 1051 et seq.) because it infringes and dilutes the famous Facebook trademark.

Infringement occurs when a third party?s use of a company?s trademark (or a confusingly similar variation thereof) is likely to confuse consumers as to the affiliation, sponsorship or endorsement of the third party?s services. Trademark dilution occurs when a third party?s use of a variation of a company?s trademark is likely to lessen the distinctiveness of the company?s famous trademark.

We have filed several proceedings before the United Nation's World Intellectual Property Organization's arbitration panel. Facebook has prevailed in each case and the domain names at issue were all ordered to be transferred to Facebook. Facebook is concerned that your unauthorized use of the Facebook name may cause confusion as to whether you or your company?s activities are authorized, endorsed or sponsored by Facebook when, in fact, they are not.

We understand that you may have registered facebookpornhub.com without full knowledge of the law in this area. However, Facebook is concerned about your use of the Facebook trademark in your domain name. As you may know, the Anticybersquatting Consumer Protection Act provides for serious penalties (up to $100,000 per domain name) against persons who, without authorization, use, sell, or offer for sale a domain name that infringes another?s trademark.

While Facebook respects your right of expression and your desire to conduct business on the Internet, Facebook must enforce its own rights in order to protect its valuable and famous trademark. For these reasons, and to avoid consumer confusion, Facebook must insist that you immediately stop using facebookpornhub.com and disable any site available at that address. You should not sell, offer to sell, or transfer the domain name to a third party and should let the domain registration expire.

Please confirm in writing that you will agree to resolve this matter as requested. If we do not receive confirmation from you that you will comply with our request, we will have no choice but to pursue all available remedies against you.

Sincerely,

Ethel

Legal Dept.
Facebook, Inc.

So if you were going to let them expire anyways, let them expire. What's the problem?

Seth Manson 04-21-2011 01:52 PM

They are being nice. You should just take down whatever is on those domains, and let them expire. Problem solved.

marketsmart 04-21-2011 01:53 PM

tell ethel to go fuck herself and that you owned those domains while zukerberg was still sucking guys cocks in highschool and if they want a fight you have a lot more money then they do....

and then let the domains expire...

.

GameForAdult 04-21-2011 01:55 PM

I did not read the half of it, facebook are 2 words I don't belief this can be trade market. I work years in arcade and guys use domains and got letters like this, if the words are common the cant have a trade mark on it. I'm not a laywer but I would call one to find out.

adultzone 04-21-2011 01:58 PM

Let the domain expires! They keep filing lawsuit nowadays because they are famous but the time that they are not yet famous they are not complaining about trademark thing!

I would give a shit about and call a lawyer to find out. Face and book are 2 common word so how they could have a trade mark on it??? They just want to scare you, I would renew and tell them fuck off

Facebook isn't trying to fuck you. In reality you are trying to fuck facebook. Facebook, like it or not, is now a recognized brand and they are within their legal rights to protect that brand.

The best thing to do is to respond to the letter letting them know that you agree with their terms, shut down any site that may be on them, and then let the domains expire. The cost to fight them in court would be too high and you would have nothing to gain if you won the suit anyway.

You're right, you're not a 'laywer', ever heard of Target, Wendys, Dodge, Shell? Think those words didnt exist until the businesses came along?

Transfer them to a random registrar under a fake name and tell them you had already been contacted by a facebook representative to do so. Put some money through some serial paypal accounts to keep the distance, more fun than lapsing

woj 04-21-2011 04:19 PM

better stock up on some lube :thumbsup

jk, just give them the domains and problems solved...

halfpint 04-21-2011 04:41 PM

Just send them an email back saying you have never heard of facebook, and will have to do some research to find out who the hell they are before deciding what your actions will be

V_RocKs 04-21-2011 04:47 PM

Drink a swig of beer every time you read facebook in that memo and suddenly it becomes fun.

DWB 04-21-2011 04:49 PM

A little bird told me they are also going to start going after the sites using things like "hacked facebook accounts."

DangerX !!! 04-21-2011 05:26 PM

This is how is today, you can have blahblah.com/productname but you can't have blahblahproductname.com and if you have blahblahproductname.com they feel encouraged to fuck you over because their lawyer says that they can so they do. Money, greed and US patents and trademarks for every fucking word in a dictionary. Isn't it so fucking hilarious that nowadays they can trademark word "face"? But yeah they have money and and government thumbup.
Oh and btw Facebook = CIA = Big Brother in your computer. :winkwink:

So you don't see a problem with someone spending money to promote a brand only to have jokers like the OP trying to take advantage of that? Should I be able to open a hamburger joint throw up some arches and call it MacDonalds?

Years ago some asshat thought it would be clever to register 4 different variations of a popular domain name that I have (a registered trademark) and proceeded to throw sites up that were similar to mine. When my Attorney sent him a letter similar to the one above he responded back that he would sell them to me for $1000 a piece along with some smart ass response that I didnt own the english language. So then not only did I have him for violating my trademark I had a case for cybersquatting which he could have been liable for $100,000 for each occurrence. We filed a Federal lawsuit and he wisely settled for 25k and the domains.

Bert Is Evil &
Mattel sucks too!

Kelli58 04-21-2011 07:17 PM

You bought two domain names to profit off of someone else's trademark and they are trying to "fuck you"? Ya funny how that works. You get that you are the one in the wrong, right? You understand that you broke the law, right?

AdultKing 04-21-2011 07:24 PM

I think you were trying to fuck both facebook and pornhub, however much I dislike these companies, you really need to re-evaluate that business model.

icymelon 04-21-2011 07:28 PM

i got one from stub hub for a domain that didnt even say the word stub but those 4 letters where in the domain. I just deleted the registration it was only 2 weeks old at the time. put the site up on a different domain.

I think it something like teenstubehub - teens tube hub
kind of silly but I just deleted it and moved on.

chaze 04-21-2011 08:30 PM

Oh I thought you knew that guy who named his kid Facebook for helping their tribe in Africa.
