I'm not a hockey fan...but one of my comic book fans showed me a video clip this picture of RAY EMERY's helmet...he TOOK THE LOGO FROM MY COMICS..trying to figure out what to do..I'm not too mad, but I'd like to at least get some recognition for the RAZOR logo

Common sense would say that he didnt take your logo, but the airbrush artist that painted his helmet for him probably did.

well if you contacted him i'm sure he'd hook you up with tickets, jerseys etc but you're not a hockey fan. you could C&D him and ask for a usage fee - if you expect too much though he'll just get the artist to redo the logo in a similar font.

Maybe he is, maybe he isn't - there may be other merchandise using the logo - posters, t-shirts, etc. The telecast bio/stats they often use to highlight a player may contain the logo as well.

It really doesn't matter. You must defend your trademark or risk losing control of it. The next guys to use it could claim they weren't copying your logo, but that of this player. Unless he has an extensive description of the logo registered he will lose. He wont sue.

i hope you aren't comparing giving away a service illegally to someone having a logo on their helmet...

I see cartoons and drawings of copyrwritten material all the time on goalies helmets, people buy the tee shirts because they like the player, not because they have 'Cujo' on their mask...

the "razor" logo is changed slightly , not a different font though, they just chopped off the little trailing thingies.

Your previous comment implied that there had to be a financial benefit to merit a suit and I was trying to point out that is not the case. Granted, it was a poor example as copyright is very different from trademark.

The only example I can think of where a blatant trademark infringement is permissible is in the case of satire - and even then, it's a single time thing.
