Can Anders Behring Breivik be declared insane without going to trial?

I heard they are seeing if he's fit for trial. Can the Norwegian authorities declare him insane and keep him locked up for the rest of his life.

This will make his mission to be heard into a joke. just don't let him out.

You gotta though have a few screws loose to do what he did

Even his lawyer thinks he's insane.

I've always thought a lot of these people, like Timothy Timothy McVeigh and Ted Kaczynski, aren't quite all there. Just because they're insane doesn't mean they can't plan a huge thing like they did. Was Hitler sane or insane? Seems he planned a lot.

too simple a solution, let him rot in prison for the rest of his natural life, give him something to think about:2 cents:

Exactly, in 10 years or so we'll hear about how he's reformed and is so sorry.

Being a shitty person doesn't make you insane. It just makes you a shitty person.

Not sure how it works in the EU, but in the States you can be declared not guilty by reason of insanity or you can be declared unfit to stand trial. Either can get you remanded indefinitely to a psychiatric facility that's probably as bad or worse than a prison.

its fucked up to say the least. they are very liberal in their system and dont feel like corporal punishment is by any means acceptable.

rather, they just say "you shouldnt of done that, bad boy, now sit in jail for a few years"

instead, that guy should be tortured for the rest of his life :2 cents:

We are not in the union, but you are correct about the psychiatric facility. He is sick but doubt he'll be declared insane. He prob wants to stand a full trial anyway to promote his sick ideas.

The thing is, we have a max of 21 years (30 if crimes againt humanity) BUT that doesn't mean you will be free in 21 years. If you are sentenced to 21 you CAN remain in prison for life if you are still a hasard towards society. That sounds very likely in this case.

He is stating that he is living in a different reality and should be examined in full.

so it's illegal to do that as a person, but as a state, totally ok?

CDSmith 07-27-2011 02:49 PM

Death by slow torture

...isn't too good a punishment for him.

And I do mean slow.

There are many things that are legal for a state to do, but not legal for the individual. C'mon, you know that. Why are you pretending that you don't?
