Police Commissioner Kelly said, "neither police nor executives from Brookfield Properties, which owns Zuccotti Park, have the authority to kick the protesters out at this point."

For the morons yelling about private property, etc. Notice the date?

baddog 11-15-2011 05:04 PM

Right, they can come there, they can't live there.

You jumped the gun. It was quickly over turned.

NEW YORK (AP) ? A New York judge has upheld the city's dismantling of the Occupy Wall Street encampment, saying that the protesters' first amendment rights don't entitle them to camp out indefinitely in the plaza.

Supreme Court Justice Michael Stallman on Tuesday denied a motion by the demonstrators seeking to be allowed back into the park with their tents and sleeping bags.

Police cleared out the protesters in a nighttime sweep early Tuesday. The judge upheld the city's effective eviction of the protesters after an emergency appeal by the National Lawyers Guild.

The protesters have been camped out in privately owned Zuccotti Park since mid-September. Mayor Michael Bloomberg said he ordered the sweep because health and safety conditions and become "intolerable" in the crowded plaza.

If they pitch a tent, they'll occupy a jail cell.

baddog 11-15-2011 05:13 PM

The movants have not demonstrated that they have a First Amendment right to remain in Zuccotti Park, along with their tents, structures, generators, and other installations to the exclusion of the owner's reasonable rights and duties to maintain Zuccotti Park, or to the rights to public access of others who might wish to use the space safely. Neither have the applicants shown a right to a temporary restraining order that would restrict the City's enforcement of law so as to promote public health and safety.

Free speech is not an en masse right. You can't yell "fire" in a crowded theater and you can't trample other people's rights.

Whether you agree or not with this "occupy whatever city" shit, things are not going to get any better. Once this "protest" (and I use the term loosely) ends; something else will start up.

I fear that every iteration of the protests to follow will become more confrontational - if not outright violent.

A staggering number of people are terrified of the future, and there are a lot of charismatic asshats willing - and able - to take advantage of those fears. Alas, there is currently no-one in power capable of assuaging the very fears they've helped propagate and nurture.

Although Democrats and Republicans may express their concerns in different ways, extremes on both sides draw their power from one source: Fear. A lot of people on this planet are bat-shit terrified. And its going to get a lot worse.

Argue about Right vs. Left all you want. It makes no difference. There is no-one in power who has the the ability to ease people's fears. There is no-one waiting in the wings with either the intelligence or drive needed to address the concerns of the people they so laughingly profess to serve.

Also, consider that I'm ignoring the rest of the world, which is pretty much imploding. Keep feeding worthless paper money into failing economies and everything will be peachy keen. That's the plan, right?

Your religious and political beliefs are now - or will very soon be - irrelevant. Hell in a handbasket. Enjoy the ride.

So does that mean I can go to where an Occupier lives and tent out on their lawn for as long as I want?

look into how those parks are zoned. some kind of private/public partnership. i think that is why the city doesn't know how to handle it at times.

Brent 3dSexCash 11-15-2011 08:37 PM

Just wait until the first heavy snow in NYC.

Suckers.

V_RocKs 11-15-2011 08:47 PM

the whole reason there is a private park there is because they traded it to the city to bypass zoning for $$$

in a nutshell
a company says " hey city , can i build a huge building here ? "
city says " no , wrong zoning"
company says " ill give you half the property and build a park on it for the public"
city says " ok "

so if owner kicks people out , they void the contract and would have to demolish pricey highrise that violates zoning :)
