Except that this isn't a trademark breach at all. He only has exclusive rights to the mark in industries he works in or is actively pursuing. He doesn't have a mobile phone so he doesn't have a right to the mark. I can create "vivid" shoes using my own design for the word vivid and he can't do shit about it.

Exactly, so like the million $ contracts he offers the celebrity of the moment this is just for press. It get's him press so good on him I suppose.
