yeaaa.. with the fact it's a phone you'd have 'vivid mobile' which i think would be seen as definite infringement

it's certainly present a problem for vivid and future markets

Except that this isn't a trademark breach at all. He only has exclusive rights to the mark in industries he works in or is actively pursuing. He doesn't have a mobile phone so he doesn't have a right to the mark. I can create "vivid" shoes using my own design for the word vivid and he can't do shit about it.
