heard the parents are not shining examples of responsibility, but based on a 'name' i find that outrageous

what about the baby named after a computer game? how is naming yoru baby based on monetary rewards different than basing the name on someone one would admire, if not questionably?

I agree that it's outrageous if it's based on the childrens names. News reports are saying there is violence in the home, and social services probably got that info from the three other kids, or they wouldn't be able to keep them in custody.

It better be about something more that just the names. Can you imagine if the gov is taking kids merely based on the parents choice of name??? That would be beyond screwed up. If there is some valid reason, then fine, but just for a name would be totally wrong IMHO

You might be surprised at the number of legal ways someone can try to take custody of a child. I had a very public case over 10 years ago where an extremely religious babysitter tried to gain custody of my son because I run a porn site. She did it through probate court of all things, and it was legal. She was a worker at KinderCare where I took my son everyday.

The whole case was BS but I was investigated with a fine tooth comb and came out squeaky clean. The case lasted over 9 months, and of course she didn't win. But the fucked up thing is that CorporationWiki shows she still works for KinderCare!

For the state to still have custody of these kids, they have to have proof (probably from the kids) that it's an unsafe environment. This is America, people are allowed to be as stupid and hateful as they want, but when it comes to a child's physical endangerment the state steps in.

Yes it is difficult to stomach that the gov can take your children based on your choice of name, especially when you have the hypocrisy of the state allowing the Westboro church to preach all manner of bigotry and hatred whilst indoctrinating their children in their madness.

The law becomes an ass when it is not applied evenly. However in both of these cases I believe that the state should act.

There is more to the story and to avoid looking shady by saying "it's personal" or "it's complicated" I've told the whole story below. I personally think it's TMI and I shouldn't have opened my mouth in the first place but here it is:

I was audited by the IRS because someone was claiming my son as a dependent on their taxes. Of course I had years of cancelled checks to KinderCare proving he's my son and I pay for his care, as well as his birth certificate with my name on it as his father, but just to be complete I went to his school to get his enrollment documents. There I found the babysitter had put herself as my sons mother on update paperwork sent to parents at the beginning of every school year. She had either intercepted this paperwork or asked for the paperwork to fill out updated info.

I then went to KinderCare and found she put herself as a contact on his paperwork there as well and had gotten insurance for him, changing his last name to her last name on the insurance card. I then went to the doctors office she listed on the paperwork as my sons doctor and found that she had been taking my son to the doctor representing herself as his mother, or guardian, I can't remember.

I confronted her and she had no answer as to why. When I say no answer, I mean she just stared at me like she was insane, and didn't answer my questions. She had also been getting very clingy with my son since her fathers recent death. So I cut off all contact.

Months later I'm served with a custody lawsuit through probate court claiming every awful thing possible about me, including that since I'm a single man, and she didn't know where the mother of my son was, that the mother could be dead or that my son was abandoned by the mother and in the jurisdiction of probate court. She didn't include in her complaint that she knew I talked to my sons mother every week or that his birth certificate was in his daycare file, proving I was my sons Dad. I live in conservative Orange County California. I was thoroughly investigated by the IRS, Social Services, and local police. The whole court case took about 9 months to complete. Things seems to be stalling and odd motions being granted by the judge so my attorneys suggested going public so the press would keep the judge, and the sitters attorney, in check. The babysitter was outed as lying many times through depositions and in her attorneys initial court filing. None of her claims were substantiated.

Needless to say I easily won the audit, and she didn't win the court case.

After the case was over I came to pick my son up from school and found him and his two friends cowering behind the bushes. I asked why. They said the babysitter was there trying to talk to my son and they were afraid she was going to take them. I went to the police. The police could not do anything because no threat was made to my son and she would have to do something before they could act. So I moved to Australia.

After years in Australia I moved back to the OC two years ago so my son would have an American high school experience. Last year, one week before my sons 17th birthday, he received some messages on Facebook that we believe were from the babysitter posing as her 19 year old half sister, saying that he was turning 18 soon and she wanted to meet. When he said he was turning 17, not 18, the messages stopped.

Two weeks ago after my son turned 18 he started getting messages again saying that the babysitter misses him and has photos and video to show him.

So that's the whole story so far. There are very fucked up people in the world.
