but if i paid for that commercial speech, got the right to distributable in whole or in part

it not that the point DMCA takedown is ONLY copyright issues using it because you don't like the implied endorsement is something that should have been settled with a lawsuit not censorship.

So let me guess, Kim Kardashian, Will I Am and P Diddy don't really use Mega Upload when they have to send files across the globe? Mega Upload prolly gave them money to say they used the service, not knowing what it was. Artists gave their endorsements, and then found out after the fact what the service is actually used for, and are now trying to retract their endorsements. But I though that these Actors and Recording Artists were smart enough to speak out about world issues and such???

There is no statutory damage provision in the DMCA for sending false takedown notices, but the sender of the false notice is liable for damages/harm that can be proven by the parties damaged by such a false notification under § 512(f).

Seems to me that a more appropriate way for these artists (and/or their representatives) to pursue satisfaction here, if they really believe their likenesses were misappropriated, would have been a "right of publicity" claim.

I don't know what all the facts are here, of course, but on its face, this doesn't sound like a copyright issue, at all.

They probably have file ID technology in place to monitor song downloads and pay royalties to the labels. But to keep the site cool, they have to retain their image of being a rogue service.
