Legal Advice - Overzealous Cop?
 
My younger brother has decided to take after me and start a website. He put up some fliers looking for models around where he lives in Northern California.

Today he gets a call from a female police detective asking all sorts of questions--is this a business? Where does he shoot? What is his name, address, drivers license #? Is he a sex offender?

Now I don't think he did anything illegal per what kind of fliers they were. But I know that in some cities posting ANY fliers is illegal.

However, he also didn't answer the questions to where the cop felt satisfied. She said he should meet with her to discuss matters.

Am I crazy, or is this police officer mixing her personal politics with her job?

Maybe they have never dealt with this up there, but in So. Cal, the one run-in I had with the cops ended the second I showed them my release form. Perhaps she does not even know that what he is doing is legal?

Best I can figure, she is trying to pressure him into not seeking out talent in that area and is hoping to discourage him.

My advice to him was not to put up any more fliers and not to return her phone calls. I told him to wait until he gets a ticket for the fliers, or if they come to arrest him (for what though, I am not sure).

I told him that if they want to have him come in to talk, to tell them he will want legal counsel present and retain a lawyer immediately.

I also told him to specify a million times over to any other girls that call that they need to be 18 or over, and to keep pristine records of their proof of age--taking that information at the very beginning of a meeting, just to protect himself.

He's crazy to be doing that. He's going to get religious freaks seeing those and filing complaints. 10 to 1 he gets pinched eventually if not now on some trumped up charge they'll throw at him just to fuck with him.

Tell him to tell the cop to go fuck herself. Cops only talk to you for one reason: they want to bust you but they don't have enough evidence and they are trying to get you to incriminate yourself.

WHen you say he put up some fliers. Do you mean he went car to car putting them under windshield wipers? If so there ARE laws against things like that. Granted if it was Bobs Deli no one would care, but that doesn't make it legal.

I put up "erotic photography" business cards in the neighborhood chinese carryouts....cops visit them all the time. I've never received a call....

And if a cop did call asking me questions about my "business", I'd just let him/her know that what I did was for a hobby.

He put up fliers on bulletin boards near the local colleges, and at the local music venue where a lot of 18-30 year olds hang out...

His flier was really mellow and slick looking... kinda rave-ish.

The first thing I tell a cop is "I want my lawyer present".
Usually they back off at that point!

As it turns out I've got the same lawyer that represents them in court so as soon as I mention his name they know that he's not going to be backing them up this time.

I'm not a lawyer and I can't say if it's illegal because I don't know where you're at but it sounds to me as if they just want to check him out.

If his worried about it have him call a lawyer.

He is trying to go amateur and got really jaded within a week of talking to girls online who flaked on him. He has been going through AOL and trying to copy how I started out...

He is too green for me to recommend him to use AdultStaffing or even OneModelPlace.

I know enough girls who are in the biz or are thinking of getting into it, and he does not have the tact to do the handholding thing yet.

That, and he for the route he wants to go, he can't use girls who are on other sites really...

I suggested he hire a few female friends to recruit for him--one works at a store at his local mall, and can probably find him some decent prospects.

I think he did the flier blitz because he was frustrated in waiting...

I remember my first month seeming endless, and it was only the beginning of a long, tense journey.... Still, beats any other job I've had.
