Satire and parody have certain protections under copyright laws. Consider Mad Magazine that spoofs every major blockbuster that comes out. So long as they stay within the guidelines of what is permissible they'll be fine.

The Rick Moranis movie Space Balls also comes to mind.

I completely understand that, but George Lucas isn't one I'd take chances with. Space Balls parodied the Star Wars films but in doing so changed the names of characters, traits of characters, etc. The trailer above indicates that this "parody" does everything possible to look and appear EXACTLY like Star Wars, only with sex stuck in.

Family Guy also parodied Star Wars. But they didn't have graphic visual depictions of George Lucas' characters engage in sexual activities. I think that fact alone will draw the ire of Lucas, and I would hate to be on the receiving end of him.

Family Guy is a bit of a special case, because one of the stipulations of the parody/satire protection is that it only applies to single occurrences - so they were protected for the first one, but arguably not for the sequel.

That said, I agree that one does not need a valid legal reason to sue somebody so taunting someone with deep pockets who can afford to draw out a legal case may not be financially advisable. In other words, just because they are in the clear legally does not mean they will not face a lengthy and costly lawsuit. The flip side is Vivid can press for summary judgment (which should be a slam dunk) and if Lucas and Co persist, they might be subject to frivolous lawsuit counter-charges. I should hope that Vivid has run all of this past a lawyer already.

Thats correct. A few Star Wars Fan Girls who worked for us at the time got together to play a live Star Wars drinking and stripping game. We put up a banner on our own site that showed a nude female silhouette battling a Darth Vader Silhouette, and we got busted for it.

Watching the trailer for StarWarsXXX there seems to be alot more going on than just a silhouette. I'm no expert but I know you can parody movies the way Spaceballs parodied Star Wars, but they didn't copy anything, so it was legal.

Kudos to Vivid if they got permission to do this, or Kudos if their sound guy made what sounds like a perfect recreation of the original Star Wars Sounds. If they didn't get the rights or permissions though, I'd be nervous about all that money spent.

1. they have made lots of these films before.

2. they are not morons. no one ig going to spend big bucks on such a film without every dot being checked by a solicitor.

3. they can afford to go to court and will be legaly covered.

4. while lucas films may send some letters, and and a few legal threats, i suspect they will not consider it worth while.

remeber they made 2 pirates of the carabian films. thats going up against disny. lucal films i would think is small fry next to them.

5. at the end of the day its vivids problem. just promote folks. what the heck is anyone bothered about? you would think they had brought out a sex film of a bunch of 3 year olds being gang babed by sheep the way somer of you are making a fuss.

Digital Playground made two "Pirates" movies. They did not make two "Pirates of the Carribean" movies. The only thing they have in common is that they are have pirates in them. Yes, DP's XXX movie made references to Disney's "PotC," but characters, plot, etc. were all different. They didn't go up against Disney or tread on Disney's trademarks. But I do find it humorous that they clear Vivid to use trademarked characters in exactly the same medium, while sending HTC a cease & desist because their cell phone named Vivid might be confused with a company that manufactures porn named Vivid.
