I don't get it - it sounds reasonable, doesn't it? First contact the site owner, then if no response, or unsatisfactory response, contact the ISP with details of communications.

Why is that unreasonable?

i've gone through this with them before - fuck them, any other host in the world accepts a DMCA abuse complaint at face value as a copyright infringement complaint, whether the DMCA is an American law or not. They host more piracy than any host on the planet. they just like to laugh at content owners and make it more difficult.

Mutt, I know that Lease are a Dutch based company but perhaps worth trying to reach their U.S support staff to see if the response is any different?

I know when I have had dealings with them (not copyright issues but sales matters) their U.S staff have quoted totally different things to me than their Dutch colleagues.

Got that from them to. So I send my DMCA's to their Upstream provider.

DMCA is not a Dutch law, they want you to follow the Dutch way, I don't see the problem here? Sure it's a bitch but people are dicks if you don't follow DMCA properly either.

When I have contacted the US staff they just referred me back to their Dutch colleagues.

They once replied to me asking what the IP address was of the site for which I was sending the DMCA notice. They host the site! They don't can't figure out the IP address of the site they host?

The Digital Millennium Copyright Act (DMCA) is a United States copyright law.

The Netherlands is not in the United States...

I`m aware of the Act and the different countries/laws. The point I was making is that sometimes talking to different people within the same organisation can generate a totally different response.

Mutt, you should do what they suggest, so that you have your proof that LeaseWeb is lying inbreed scum. This: "LeaseWeb has a policy banning illegal distribution of copyrighted material" is a lie because they don't ban anything, they will only ask the site owner to remove the file. If you want to see how this works for the other site, just open an account at Oron.com, upload something, report that file to LeaseWeb and check whether the file is really deleted or whether only the Oron link to that file is deleted.

Once you did all this you have your proof and you can join me and the other producers who are preparing a law suit against LeaseWeb.

Also, I'm Dutch, and LeaseWeb's attitude is not representative for the general Dutch attitude about thieves. LeaseWeb has been covered by Dutch media many times and most of the times it was in a very negative way. They were sued many times about copyright infringements through torrent sites and were always ordered to take these sites down, they never won a case.

5 day delay might be too long, I'd lower that to 3 days...
but looks like Dutch folks answer emails slower...

Just copy the host in when you send complaints to the site direct, you are then obiding by the rules but at the same time informing the host that they have a customer who is in violation - the more that customer comes up indirectly with the host the sooner they will get fed up with them and suspend their account when the rules were followed. The site owner will also see you copied the hosts in and most will act a little quicker in removing your stuff.

Well it wouldn't all be so bad, if only this "If you have not received a
response after 5 days you can contact us again" wouldn't be there. Because this means that everytime you find stolen content and the site owner ignores you, it will take at least 5 days before LeaseWeb will remove it, while it takes 10 minutes for the average pirate to put that file back online. So really time to take legal action against LeaseWeb now.
