Question about copyright infringement lawsuits
 

If you catch somebody red handed stealing and using copyrighted content when it comes to a judge awarding damages does the type of usage the thief was using the content for play a factor in how much the damage award will be?

i.e. somebody using your content on their Facebook page versus a publically traded 400 million dollar company using your content in their advertising seen by tens of millions of web surfers a day

Yes. The $400 million dollar company would probably get nothing. And the somebody putting your image on their personal page would get a $500k fine and 5 years in prison.
