?I told the officer, you know, don?t shoot my dog cause I knew the dog was going to run forward towards us,? Paxton, a 40-year-old lab tech, told msnbc.com. ?He (Cisco) ran to the officer?s feet; the officer shot him and killed him.?

?I was panicked, traumatized,? he said, noting that Cisco -- who he said has never attacked anyone -- was like his child. ?It?s a very painful loss for me.?

The policeman had been responding to a call about a man holding a woman against her will and fighting out front at the address, Sgt. David Daniels, a police spokesman, told msnbc.com. But the pair didn?t live there and were not on the scene when the officer arrived, he said.

That was not known when the officer reached Paxton?s home, Daniels said, adding that police did eventually find the pair, who lived a few doors down.

?It?s unfortunate that these two particular individuals were fighting in front ... of that location, but that was the location that was provided to the officer,? he said.

From a recording made at the scene, and played on a local affiliate, the officer can be heard yelling, ?Show me your hands! Show me your hands! Hey, get your dog!? and then a shot is heard.

An exchange continues between the pair, with the officer asking Paxton why he didn?t get his dog.

?You pulled a gun out and told me to put my hands up. What am I supposed to do?? Paxton replied, according to the recording.

Daniels said the shooting was deemed justified and that police policy allows for officers to use deadly force to neutralize any animal they come across that poses an imminent safety threat.

?We encounter dogs all the time,? Daniels said. ?This is not the first dog that we?ve shot. ? It?s unfortunate. We?ve apologized to the gentleman -- not for the fact the officer did anything wrong -- but the fact that his dog was killed.?

Daniels said Cisco had come out ?charging? the officer in an aggressive manner, though Paxton disputed that, saying his dog ran up barking like he would to any stranger. Daniels said the officer feels bad about the incident.

Cisco was a Blue Heeler (there are also Red Heelers; they are named by the color of their fur). The breed is popular in Texas because of its skill at herding cattle; they instinctively nip at their heels, Paxton said.

In the aftermath of the shooting, Paxton has called for an improvement to police policy about how to handle animals in such situations, including providing a clear definition of what behavior is ?threatening? to ?clarify the gray area that there seems to be.?

One thing I will say my dogs are always on a leash out side so I have control.If I was doing nothing wrong and a cop shot my dog by mistake. I probably would wind up arrested anyway because I would lose my shit.

So far in my life I've never met an asshole cop. I've had cops let me go on different occasions for stuff like speeding, going through a stop sign, and falsely thinking I was talking on the phone (which I was't I was taking my sunglasses off at dusk). I've been interviewed by detectives that were respectful and cool.

Stories like this do show there are a minority of complete non thinking individuals who are employed as cops and it's bullshit. There has to be a better way of weeding people like this out of every police force. These kinds of guys are just like the ones who tase people before simply talking to them to calm them down instead.

I'm sad for the guy and his companion 7 year old pup. Hard shit to read first think in the morning I need to remember GFY is for later in the day FUCK!

I would let that cop know that he will pay and that there is not a god damn thing that he can do about it. The law protects nobody, it only punishes you for your crime IF they can figure out who did it, and prove it and catch the guy. But nobody is untouchable.

Yes, but cops have rights too. A friend of mine was a country sheriff and was once brutally attacked by a dog. She was out of work for six months, and years later is still affected by it - she just had an operation needed to fix a muscle from the dog attack.

Cops come across dogs on a daily basis, being as they visit people's houses - usually under emergency circumstances. You and I picture a cute dog running up to us, but for cops they see snarling attack dog.

Keep in mind I have a dog myself, a black lab that goes running with me twice a day.

I'm a dog lover and owner myself but I can't help but laugh at the idiots in this thread that have no idea how their own legal system actually works.

Yeah yeah you'd all sue. What would you sue for? The cost of the dog? Dogs are considered property.

you could sue for loss of companionship for one...in canada...would it be worth it? no

however in the usa...i believe you could also sue for pain and suffering, and since a dog is considered a child to most, that is a lot of pain and suffering.

I also didnt say i would sue.....i said, i believe a lawsuit is coming.

You couldn't sue for "loss of companionship" in Canada. At least not in British Columbia. Dogs are property, period. I've been through this, you can sue for any direct costs and that's about it.

Hmm apparently there has been one decision in Ontario for such a thing involving negiligence at a kennel. It was even held up on appeal. You'd have a very, very, very tough time proving the a police officer following police policy was negligent though.

In general, however, you can only recover the direct costs related to an animal.

There are a few exceptions in the states, but Texas is not one of them.

Cop is most likely covered.

1. Sent to a call on a domestic dispute. ( one of the most dangerous types of calls )
2. Call was bad enough that he entered the house with his firearm out and ready.
3. Dog comes in barking and moving towards the cop in what the cop most likely thought of as an aggressive manner.

me in his spot, I would have shot the dog as well. It put him into a dangerous situation with the man at gun point and the dog coming in.

At the end of the day the cops main goal is to go home to his family and loved ones in one piece.

And as usual, there is a lot more to this story than we will ever be told.

I've had my run ins with barking dogs and usually they will stop next to you and keep barking but not bite. Cops carry alternatives such as pepper spray and batons but sadly most of them are just pigheaded. He took the opportunity to shoot the dog and flex his authority just like most cops will do.

They can't find anything wrong. The tax-payer funded cop unions will threaten to use taxpayer funds to defend their tax-payer financed cops against any complaints that a taxpayer may have.

So, do you suspend a cop with pay, full benefits and pension (all taxpayer provided) - or do you fight the cop union with taxpayer money - and STILL provide the fat donut eating asshole with a full pension and benefits?

A dog is property so you can sue for the cost. With mine one was free and the other was $40 from the pound. If you watch the cop cam this guy was ready the minute he stepped out of the car. He was pointing his gun at the guy and he didnt even know who the fuck he was. You hear him say put your hands up, you hear a bark and shot.The owner never would of had time to react without getting shot. Nothing will happen to the police officer.
Thank god the cops here seem to keep it together well, dont jump and then ask questions.
