What war do you speak of?

A war is when the governments send their military forces to fight each other. The Iraqi government collapsed in a matter of weeks, and the Iraq military pretty much just dissolved and went home. The Iraqi government was replaced, and a new military created.

While I hate defending Blackwater, they aren't mercenaries - They don't have front line troops, they don't fight in military engagements, they don't have jet airplanes or tanks.

You also need to be very careful what you consider "mercenaries". Both the French Foreign Legion and the Gurkhas are mercenaries, but yet the are in fact allowed to wage war under Geneva Convention.

You don't understand what war is, you don't know what Blackwater does, and I'm guessing you don't know what a mercenary is or how the Geneva Convention applies.
