Universal & Fifty Shades Ltd Going After Smash Pictures?

http://www.tmz.com/2012/11/29/univer...ght-trademark/

Looks like the porn was a bit too close to the books. Or maybe they just want more hype for the mainstream movie they are working on? Either way, this will be interesting, as the movie does lift a whole lot of dialogue from the book.

Should be interesting

Maybe I am out of the loop but never heard of this studio that made it, Smash Pictures.

I wonder if their smaller size made them a target versus a company like Hustler who has done a ton of parodies.

Either that or maybe they simply pushed it too far.

not covered by parody?

That's what I thought when I read the headline, but the article says...

Quote:

According to the suit, "The first XXX adaptation ... does not comment on, criticize, or ridicule the originals. It is a rip-off, plain and simple."

The suit continues, "By lifting exact dialogue, characters, events, story, and style from the Fifty Shades trilogy, [producer] Smash Pictures ensured that the first XXX adaptation was, in fact, as close as possible to the original."
And in a way, they're right. There are some scenes in the movie that aren't in the books, but they are derived from actions / conversations in the novels. Other scenes are word for word from the novels - which is why the Fifty Shades fans love the porn.

Shakespeare is public domain.

Normally I'm pro porn and hate hollywood for sticking their noses into business that doesn't concern them but the whole "Parody" genre just needs to die. It's stupid and a waste of porn. Parody is killing porn. It seems like everywhere I turn, I see a new stupid parody xxx movie. The first ones were funny and it was a new concept, but now it's just plain stupid that every movie/reality show has to be made into a stupid parody.

Case and point

I agree for the most part, but I think this particular situation makes sense. Fifty Shades is all about the sex. There's 13 sex scenes in the first book alone.

There's no way that any mainstream film will do it justice and give the readers what they actually want. My money is on Universal turning this into some mildly kinky coming-of-age movie, when reality it's all about the fucking. Women are swooning over the fact that they might get to see Matt Bomer or Ian Somerhalder getting naked and screwing some young actress when all we're going to get is maybe some R-rated tit flashes and some sheet shuffling.

IMO, this one wasn't a parody - it's how the movie should have been done, and I think the bigger studios dropped the ball on it. (Not that I don't think Smash did a good job.)

Probably a freshly minted company, just for the production:2 cents:

Dudes, what? Smash has been around a long time!

I bet this lawsuit sends sales of their porn version through the roof!
When we made a porn spoof of Punk'd we were PRAYING Ashton Kutcher's company would sue us!

P.S. they'll never win the suit against Smash - clearly a parody! NO mistaking it for the actual book/future movie...

RubyGoodnight 11-30-2012 09:20 AM

I know I'm seeing a bump in traffic from all the hype. Hoping it translates into sales!

stephane76 11-30-2012 09:32 AM

The movie is doing extremely well on VOD, you're losing out if you're not pushing traffic to it :thumbsup
I have exclusive banners for it as well (in 28 different sizes) :winkwink:

Bit of an update and a hope for more info!

This Isn't Fifty Shades Darker (the second of the three part series) was supposed to be released on Jan 10, but I found out last week it was delayed due to this law suit. Now I'm getting comments from blog readers who preordered the vid directly from Smash, saying that they've gotten emails from Smash saying the porn has been discontinued.

Anyone hear something similar?

Haven't read the book(s), but neither trailer is very compelling to me...

Not to burst anyone's bubble but in a trademark and copyright dispute like this the Court is likely to gran an injunction if it has not already. Also, if the Court finds in favor of the defendant then there is a good possibility that anyone that sold it might be liable, and that means on or offline.

Sounds like the company has already weighed the risk and determined that there are issues if they are not selling it anymore regardless of an injunction being granted and that should tell you all you need to know.

I have said many times how dangerous this ground was.

That's not an official one. Lots of fans are making their own fantasy trailers, and that's one of the better ones.... :thumbsup

I'm not all that surprised that it's ended like this. The first porn tread a very fine line that I'm sure would have never made it through a court battle. Even though I kind of new it was coming, I was gearing up for a push on it's release. Oh well...
