I am not a legal professional in any way, but as I understand it, Freeman v. California was adopted (or something) by New Hampshire, thus CA and NH are the only states that appear to allow porn -- porn is one thing but, obscenity is a major "no-no" consideration in ALL of America; See Miller v. California for info about obscenity.
Talk to an experienced First Amendment attorney (and, in addition to your above question), get familiar with U.S. Code 2257.
Also, you might find that piracy makes it difficult to make good money now days.
