If it wasn't years and years, I would.

The only reason I did not do time in Florida was because I myself took the initiative to look up every case the arresting Officer ever participated in the prosecution of. I found out that he only did traffic but sometimes responded to calls. Every time he was ever called out to anything he charged someone with assault, resisting without, etc. Almost every time the DA would dismiss almost all of his bullshit before it even made it to court. You can laugh all you want but if an Officer ever hurts you and then charges YOU with assault and wants you to eat a felony maybe you'll understand.

The only reason I'm doing 2 days jail in Kansas instead of 5 + 85 house arrest is because I noticed that my case showed that I was charged under wrong subsection of the statute. I think that my lawyer would have found that on her own, but I'm sure glad that I did, because I could have unknowingly accepted a sentence that was far too harsh for the charges against me. I can't afford to defend myself BUT at least they are not going to cause as much harm against me as I was told they were going to.

Now, while I KNOW that I'd be eaten ALIVE trying to represent myself or anyone in court, if I'm this useful now- imagine what I could do if I was actually qualified.

I think that anyone who can't afford a lawyer should absolutely take some time and try to figure out what is going on. It's worth the effort and can really pay off.

Never give up. I'm not.

I'm even coming up with a way to fight the driver's license suspension, now.

Just don't give up. Just because you're poor, maybe you're black, maybe you know all too well that only wealthy people have a chance in courtrooms, maybe whatever the fuck else- no matter what- do not give up. Give yourself a chance. Because: When no one else is going to give you a chance, it's up to you to give yourself one.

If I can make it through some of the shit I have, so can you, and some of you been through a-lot more than I have and still made it. I know motherfuckers got put down for real bids and still came the fuck back up. Some of them is wearin suits and ties and all white now, even. There's even Soldiers over there fighting and they watch their friends die, they lose legs, and they make it.

Not what I said, at all. I said imagine what I could do if I was actually qualified, since with no qualifications at all I was able to find important information. I am a little confused. I can appreciate that you did your homework on the case. Anyone should do that, but most people will not. However, it sounds like the fact that most of the time he charged people with resisting/assault it got tossed really doesn't have much if anything to do with your case and you just got lucky.

Many cops will write/charge someone with everything they can think of. They do this for a few reasons. First, it ups their stats and makes them look good and the more they charge you with the better chance they will have of having at least some of it stick so I would imagine most cops have most of their charges dropped when the case actually moves towards trial.

Still, it sounds like you got lucky. He made a mistake and you were able to find it and take advantage of it. I had that happen once too. I got a speeding ticket, but my car was an Eagle Summit and he wrote down a Toyota Summit. The ticket got tossed.

Be honest. Had he not made that mistake would you be in much deeper shit?

Does this mean that once the mistake was pointed out they dropped some charged therefore you avoided any punishment for them or does this mean that they modified the charges to put them under the correct subsection which then carried a much lighter penalty?

Also, you say you never drive drunk, but you were charged with DUI. Had you drank at all in the few hours before you got behind the wheel? You might be shocked at how little you actually have to drink to be over the legal limit.

Here's the thing: you invested a lot of time doing research on this case because: 1 - it's your only case, and 2 - it's your ass on the line. You have to ask yourself: would I have the same fervor and tenacity if I was juggling 50 cases, none of which involved the possibility of me going to jail personally? A lawyer who handles every case as if it's their only case, with their own ass on the line is a great lawyer. News flash: this type of lawyer pretty much only exists on TV.

They lawyers were telling me I'd be sentenced to 5 days jail + 85 days house arrest.. Then I read the statute myself and found out why. It was because on my case it said the statute number subsection E which describes punishments for FOURTH offense. 5 days + 85 is minimum sentencing for FOURTH offense.

So now I am eating a sentence more in line with what I am actually charged with. Second offense, since I was convicted of one back in 2007.

Good point. I am one of the most loyal dedicated people alive, though, if you're my client I'd cut off my arm to save your fucking ass if I had to. I've never bailed on anyone, ever. No matter how tough or scary or dangerous the situation was, I never ran from shit when anyone needed me.

So yeah I think I'd pretty much LIVE for my cases if I was going to do it I'd go all of the way. But I doubt I can just go to school all of a sudden after 20 years, you know?

One of my closest loved ones died in a drunk driving accident, so I know exactly how you feel. I hate drunk drivers. I've put countless idiots I didn't even know in cabs, sometimes with my last few dollars, and stopped several other people who were driving drunk.

Of course, in FLORIDA - they had to throw out A LOT OF CASES because of the god damned SAME VERY MACHINE - AND - Florida even SUED the manufacturer. So you might not have to go through THIS. In the interim, stop talking up out of your ASS. Here in this state, in one county, the prosecutor refuses to allow these as evidence because they're such fucking bullshit. Kansas even PAID to make it LESS ACCURATE. Several other states have sued the manufacturer and no longer use it.

Kansas even PAID to make it LESS ACCURATE. Several other states have sued the manufacturer and no longer use it.
