DMCA clearly states it is legal for them to steal any and all of your videos and monetize them however they see fit, so long as they take the videos down once you request they do so. It's not pornhub that is the problem, it's the law.

I was just about to say, 10 years ago in this industry if a site stole content from other people like the tubes do today they would have the wrath of the entire industry raining down upon them. Today nobody cares and they don't even call it stealing they call it user generated content. Sad state of affairs.

This isn't technically true. IANAL but

1. The DMCA may not even apply to them if they are not in America. I'm uncertain of the specific ramifications of whether or not they have a U.S. presence or U.S. shell companies.

2. The DMCA does not give Pornhub or any other tube the right to steal your content. If they either upload the content themselves or purposely conspire to see the said content uploaded there is no DMCA protection.

3. Even if the content is uploaded by a legitimate user under the DMCA Pornhub and other tubes have certain duties as it relates to things like repeat infringer policies.

4. But yeah money talks. Even if you catch them with their pants down and you have a legal opening you need the money to take them to court and see the case through.

5. There might be other laws on the books in their own jurisdictions which are stricter than the DMCA. But see #4. :(

The whole situation with these tubes reminds me of the Mafia. Normal people don't have the resources to stand against them. To stay in business you have to work with them because they took all the traffic. Sponsors now have to use the Content Partner Programs of these tubes. It reminds me of protection money because I hear in some cases joining the CPP helps prevent them from keeping your stolen videos up.

Calling it Racketeering isn't much of a stretch at all. It's too bad no one gives a shit about porn to do anything about it.


EDIT: It's also interesting that you say your topic was removed. If true that reminds me even more of the Mafia and conspiracy type behavior.

I guess I just remember when I was starting out in 1999 how heavily some stuff was policed. I had a site where I was using sponsor provided content and had banners up for them, but I also had an ad for a site that wasn't that sponsor's on the site and I had a few different link sites tell me that they wouldn't list me because I was breaking the sponsor rules. I also remember a site using stolen content (can't remember who it was now) and the people on the boards jumped all over them and they were out of business soon.

Maybe I just have a different perception of it and it was happening, but more in the closet where now it is out in the open.
