So now anyone that uses porntube.com in their domain, can expect to have their domain handed over if the porntube.com owners decides to go for it?

So is the fact that the owner of the domains was a porntube affiliate. If you're using someone's mark you'd better make sure you have it in writing that they're fine with it.

I wonder if they could have a root domain siezed if one of the words is used in a subdomain, ie.: tube.somethingporn.com or somethingporn.somethingtube.com? Do the words have to be adjacent, like somethingporn.tubesomething.com or would porntube HAVE to be unbroken in the address?

Pretty crappy that PornTube allowed the sites to build up to 8% of their traffic AS an affiliate before taking action.:disgust

Looks to me how they have trademark to porntube.com ,not porntube(as that is too generic),so if dude would have different extension he would be safe,i believe.On his place i would do 301 redirect asap to save as much is possible traffic.Also in theory tube.com could sue porntube.com ,but again if porntube.com is trademarked already then such things is not an option.That is why is good to trademark your domain name before you start building serious traffic on it.

You can be sued as well for that,i think microsoft or apple was suing for subdomains on twitter and similar services.There was also case with one sponsor which was attacking affiliates with subdomains which matched their trademarks,search gfy to find a thread.

I know they can be sued and sponsors can terminate an affiliate account for it, but can the root domain be siezed if it does not contain the trademarked name? I have a gay site using tube as a subdomain (gay is in the root domain) because I didn't want gay/tube to appear together.

No they cant seize domain name,they can just get you to remove subdomain or hand over to them.

Hopefully they are solvent enough to survive the legal costs of the case, the appeal and any further litigations. Would be great if the case blew up their traffic from the exposure and a big search engine boost...AND they send it all elsewhere:winkwink:

What a bunch of scumbags. It's no surprise just search on the forum and look at their site. They did this to one of their affiliates. So it just goes to show that you should not work with these people because they will fuck you. But if you had any sense you would already know that.

They've always been about stealing other's work or otherwise conning people into into giving them content our of desperation. What did you expect? They're assholes. Most of the people at the top in this industry are assholes.

porntube.com owner Coolness is greedy idiot, he invited this affiliate to promote his tubes personally, paid him $XXX.XXX during 20 month for traffic and clear knew all these domains. Seems later he decided to get all of them for free

as result 4tube/porntube will be banned in 100's affiliate traffic generating sites, plus Coolnees got the reputation of asshole
