she had sex with someone under 18 right?

Crazy Enough 10-08-2013 12:23 AM

I don't think that it's bad if they have the same age.

Hell. Who cares what I think anyway.

jscott 10-08-2013 12:45 AM

18 and 14, pretty unfair imho

...the 14yo parents knew about it, and said they turned to the law "at last resort" if they really thought it was such a horrible terrible crime they probably would've beat the 18yr girls ass, physically kept their 14yo child in their sights 24/7, etc etc....

...fucking lame, the 14yo parents should be punished imho

mikesinner 10-08-2013 12:56 AM

I renumber when I was in high school back in 93-94 a lot of girls where complaining that they couldn't get a date to prom because a lot of the Senior guys were dating freshmen girls. A lot of jocks seemed to do this. This was also in a very conservative area.

This ain't something new but I don't know the details of this. I have to assume these parents where biased against the lesbian relationship. Unless it's a situation where the older girl was forcing the younger one into the relationship. It does sound like she was very sexually aggressive, I mean a lot of teens are into sexting these days but sending masturbation videos to your BF or GF seems a bit far.

MrBottomTooth 10-08-2013 01:07 AM

Lol at police recording phone calls between 2 teenage girls to see if they're having sex. Awful.

seeandsee 10-08-2013 04:00 AM

WTF IS THIS, are they normal to sentence her 15 y for that, come onnnnnnnnnn

iwiiiiiiiiii 10-08-2013 04:02 AM

Replace that girl by an 18yrs old boy, the speech would be kinda different.

Doesn't mean it's right to send these kids to jails for that though......

kane 10-08-2013 04:41 AM

It sucks, but it sounds like the 14-year-old's parents made it pretty clear to them that they would report this to the police if they didn't stop.

I would imagine both girls assumed her parents were just bluffing. You could accidentally kill someone with your car while drunk and do less time. Our prison system and justice system are messed up.

This is the kind of stupid shit that happens when you inject profit into the justice system.

You made a little mistake there in what you said.

We dont have a justice system. we have prison system.

Personally, I think there is a pretty big difference between the maturities of 14 and 18 year olds. If I had a 14 year old daughter, I would be incensed to learn an 18 year old had initiated a physical relationship with her. That said, it is very unlikely the defendant will receive the maximum sentence of 15 years.

Quote:

"Romeo and Juliet" exceptions

Named after Shakespeare?s young lovers, ?Romeo and Juliet? exceptions are intended to prevent serious criminal charges against teenagers who engage in consensual sex with others close to their own age. In Florida, there is a limited Romeo and Juliet exemption for consensual sex when the minor was 14-17 years old and the defendant was no more than four years older than the victim. If the defendant meets certain eligibility requirements, the exception removes the requirement that the defendant register as a sex offender. However, it does prevent him from being fined, imprisoned, or both.

Arizona

The age of consent in Arizona is 18. However there exist in the legislation defenses to prosecution if the defendant is close in age to the "victim" or a spouse of the "victim". Note: these are not close-in-age exceptions but defenses in court. Arizona Revised Statute 13-1405(A)

13-1407 (Defenses)
B. It is a defense to a prosecution pursuant to sections 13-1404 and 13-1405 in which the victim's lack of consent is based on incapacity to consent because the victim was fifteen, sixteen or seventeen years of age if at the time the defendant engaged in the conduct constituting the offence the defendant did not know and could not reasonably have known the age of the victim.
D. It is a defense to a prosecution pursuant to section 13-1404 or 13-1405 that the person was the spouse (legally married AND cohabiting) of the other person at the time of commission of the act...
F. It is a defense to a prosecution pursuant to section 13-1405 if the victim is fifteen, sixteen or seventeen years of age, the defendant is under nineteen years of age or attending high school and is no more than twenty-four months older than the victim and the conduct is consensual.

Arkansas

The age of consent is 16, with some close in age exemptions.

Details: The age is minimum 16 for a minor (<18) with a major more than 20 years old. Under 18, the younger must not be less than 14, or if so, there is a defense if the minor is not more 4 years younger if above 12, not more 3 years younger if under 12. Sexual intercourse of a major and a minor under 14 is a rape.

Arkansas Code - Title 5. Criminal Offenses - Chapter 14. Sexual Offenses. Sections 5-14-

103, 124, 125, 126, 127

5-14-127. A person commits sexual assault in the fourth degree if the person: (a)
(1) Being twenty (20) years of age or older, engages in sexual intercourse or deviate sexual activity with another person who is: (A) Less than sixteen (16) years of age; and (B) Not the person's spouse; or

(2) Engages in sexual contact with another person who is: (A) Less than sixteen (16) years of age; and (B) Not the person's spouse.

(b)
(1) Sexual assault in the fourth degree under subdivision (a)(1) of this section is a Class D felony.
(2) Sexual assault in the fourth degree under subdivision (a)(2) of this section is a Class A misdemeanor if the person engages only in sexual contact with another person as described in subdivision (a)(2) of this section.

California
The age of consent is 18, with a misdemeanor if the minor has 3 or fewer years of difference with the major, and potentially a felony if the major is more than 3 years older. Penalties increase if the adult is 21 or older and the child is 15 or younger. It is automatically a felony if the minor is under 14.[48] It is worth emphasizing[citation needed] that unlike some other states, the close-in-age rule in California (3 years) do not provide an exception nor provide any defense;[citation needed] it merely lowers the crime to a misdemeanor.[citation needed] Under this law, two minors of the same age could both be prosecuted.[citation needed]

And so on...

Vero Beach, Florida (CNN) -- Kaitlyn Hunt, the 19-year-old who has been jailed in Florida over a sexual relationship she had with a 14-year-old girl, pleaded no contest Thursday to five charges as part of a deal brokered by prosecutors and her attorneys.

Hunt pleaded no contest to two counts of misdemeanor battery, misdemeanor contributing to the dependency of a child and two counts of felony interference with child custody.

Hunt has been in jail since August 20 for violating a court order not to contact the alleged victim.

Under the terms of the agreement, Hunt will be sentenced to four months in jail, to be followed by two years of house arrest with electronic monitoring, and nine months of monitored probation after that, according to prosecutor Brian Workman.

If she has no violations, she will not be a convicted felon under Florida law, and she will have the possibility of sealing her file and having the case expunged after 10 years, he said.

The case garnered attention as Hunt's lawyers claimed that authorities wouldn't have gone after her if the situation had involved a male and a female instead of two teenage girls. But after Thursday's court hearing, Workman said the case would have been no different if Kaitlyn was a boy.

Hunt's parents have been critical of the victim's family for going to police over the relationship, repeating that criticism Thursday.

"If we start arresting kids for having sex or sexting, you might as well turn the high schools into prisons," they said.

The victim's family released a statement saying it was never their intent to harm Hunt, and the case was never about gender or sexual orientation.

"It was about age-appropriate relationships and following the rules and laws of our society," the statement said.

Hunt was 18 when she was charged with two felony counts of lewd and lascivious battery after she was accused of having sexual relations with the girl, who was 14.

In Florida, a person under the age of 16 is not legally able to consent to sex.

This is two high school kids having sex. High school seniors, who are usually seventeen or eighteen, date high school freshman. It's a fact of life. When I was in high school most of the senior girls dating college kids, and most of the senior boys dated freshmen.

I guess statutory rape rape only applies to 18+ males dating younger and not vice versa ?

It goes both ways...
