Pirate tube asking for model release, ID and 2257 after a DMCA
 

Anyone got this before?


Am I the only one getting this or now pirate sites don't feel it's enough to blatantly steal... They have to get the content free for themselves too? Is it the new thing?

I've been threatened to get sued if a DMCA made a pirate website go offline before as the owner told me he would lose money (I wished he did). But, otherwise I've had reasonable success with DMCAs.

Anybody else got similar stories?

You dont have to prove that you own it to the pirate, he has to prove that he owns it to the his host, registrar, and whoever else the DMCA was sent to.

I had DMCA once where some fucktard claimed a well known porn model was his wife and claimed I hacked into his PC. Some people are batshit crazy

We've always used xhamster & pornhub to show our movies, they also remove videos immediately when asked.

What everybody said here is correct. Don't give them a fucking thing. If there is a dispute sometimes you have to give a little(maybe screenshot from your members area) but in no way would I give up a models name, contract, 2257.

Like Seth said said go upstream if they don't comply. Host, advertisers, registrar, upstream hosts, visa/mc etc...

For now, the content is removed. They're still asking for them. They won't get them though.

Glad we jumped ship on them not long ago. Their tactics are starting to add up to make me think they are about to flip a big "fuck you guys!" switch real soon.

First, they are caught targeting site brand names in their SEO to bolster their own pages with no links or videos from that brand name listed.

Then, they began to require uploaders click away intellectual rights to the videos or face deletion

That's Lee Holloway, Matthew Prince and Michelle Zatlyn btw. The founders of CloudFlare or as some call it CrimeFlare. They even pose as pirates.

The fucked up part about this is even brassmonkey can send standard DMCA email from gmail account and claim he is the owner of $5 dollar video you bought from Paul Markham 10 years ago. Tube owner (those that do) emails you and requests proof and you have to look for paperwork to prove some punkass is full of shit.

The law is the law, it's not perfect (not even close) but it's all we have at the moment.

As the law stands, all you need to send is a DMCA notice as proscribed in the legislation.

Isn't it possible for someone to challenge a DMCA though? I'm not saying that's the case here - but I do know alot of these big tubes now do buy content and upload it themselves, it's not outside of the realm of possibility that they DO own rights (or at least think they own rights because they were sold them by a content broker) to certain content that someone is DMCAing...

Yes, you can issue a counter notice to a DMCA using the proscribed process as detailed in the Digital Millennium Copyright Act.
