Garbage Man Sentenced To 30 DAYS IN JAIL For Picking Up Trash Too Early
 
Well this is garbage.

A sanitation worker in an Atlanta suburb has been sentenced to 30 days in jail for working too early.

Kevin McGill had been working for only a few months for a company contracted to do sanitation work in Sandy Springs when he was cited for picking up trash just after 5 a.m. one morning, according to WSB-TV.

That violated a city ordinance which limits trash pickup to between 7 a.m. and 7 p.m. The statute is in place because residents have complained that early pick-up disrupts their sleep.

When McGill showed up to court to answer the citation, Sandy Springs prosecutor Bill Riley sought the maximum punishment against him ? 30 days in jail.

And in a trashy move, a judge granted Riley the request.

?Fines don?t seem to work,? Riley told WSB. ?The only thing that seems to stop the activity is actually going to jail.?

Riley, who jailed another sanitation worker for the same infraction last year, said that residents swamp 911 with calls when trash pick-up occurs too early in the morning.

?The solicitor said it?s automatic jail time,? McGill told WSB. ?He didn?t want to hear nothing I had to say. I said it?s my first time.?

?I was stunned. I didn?t know what to think. I was shocked,? he added.

McGill, a family man, did not have an attorney during his sentencing. He pleaded no contest and took the punishment, agreeing to serve his 30 days spread out on the weekends. He began serving the sentence last weekend and will do so for 14 more.

?I just want this to be over with,? McGill told WSB. ?I?m away from my family, my wife, and she?s got to take care of the two little boys and I have four dogs.?

McGill has an attorney now, and she believes the sentence is too harsh.

?Give him a warning,? the lawyer, Kimberly Bandoh, told WSB. ?I mean he?s the employee. He?s not the employer. Sentencing him to jail is doing what??

But Riley appears to be unmoved, saying that McGill, and not his employer, is responsible for operating his own garbage truck.

?The company doesn?t start that truck up,? Riley told WSB. ?The company doesn?t drive that truck down the street.?

yup me too.. Nothing would piss me off more than to take the trash out in the morning and find out they already came though before I woke up. (I live in a area with dogs and racoons so I can't put out trash the night before)

And my last post was sarcasm.. I don't think he should've got a month but hey it happened.

After this - at 7:01am I'd be clanging the hell outta all the garbage pails making as much racket as I could. Rev the engine awhile. Throw it in reverse and let the beeper annoy the fuck outta the neighbourhood.

It's not about being eager to work.. These guys are starting so early, because they have less trash to pick up being many don't put their trash out till the morning. It's a shyster move to get out of work. He's probably a contractor of some sort and sounds like it's a common tactic being others have done the same..

Sucks being a Suns fan living in Indiana. I pay for league pass to catch all games but it's still not as good as living in phx and going to games.

This is very possible, but if it is shouldn't that be a civil case and not a criminal case?

I would be all for fining this guy or even suspending him without pay for 30 days, but to put a guy in jail for 30 days for something like this is fucking ridiculous.

but this is the same, if not more, amount of work, the garbage doesn't go away on its own. garbage man will just have 2x more garbage next time.

From the quotes in the article, it seems they have tried fines in the past and these guys still do it. Seems to me they were sending a message. Also he is likely not a employee, he's likely a owner operator and those types of operations are notorious with mob ties/mob run unions.

In your own quotes.... "HIS OWN GARBAGE TRUCK" This is a common thing in some states/cities they use owner operators as contractors.. Kinda like cable installers and so forth.. They don't have a contact with the city or town they use their own trucks working or the actual contractor.. ie like a trucker..

13 years ago before I worked in porn I worked at a large printing factory as a fork lift driver for 11 years. I was told to check out and care for "my" fork lift before each shift as I was responsible for it. That didn't mean I owned it just that during my shift I was responsible for that machine. You could be right, I just didn't see anything in the story that said he owned it. I knew a bartender in PHX and her husband worked for sanitation. He didn't own his truck but he had to wash it everyday and he always drove the same truck that was assigned to him.

Simple solution. If he was doing this on his own and not by order of the company he worked for suspend him without pay for 30 days. When he comes back, if he does it again remove him from the job, or make the fines so severe that companies do pay attention to them. If it is a company thing and they are telling the employees to do this then either fine them heavily or just take the contract from them.

To me putting someone in jail should be a last resort. Our country is becoming one where our first response to anything is just throwing them in jail.

The trash man with a family to support forced to pay a months wages for doing his is job a little early for the first time? and how well do you think this guys going to do his job when he goes back to taking out the trash? You really think he's going to serve that community to the best of his ability now? Gonna be a lot of smashed cans and broken mailboxes over time I'm guessing lol

A couple of summers ago, I just got up regularly at 6am because that is when the Republic truck did the dumpsters on my end of the apartment complex... all 8 or so within earshot of my windows.
