I got scammed by Brandon Kagey from Scriptworkz:

I filed a Paypal dispute, and they closed it within 6 hours saying:

We completed our investigation for the following transaction:

Case ID: PP-003-800-859-539
Transaction Date: Feb 24, 2015
Transaction Amount: -$XXXX USD

Seller's Name: Eric Frye


Unfortunately, we are denying your claim because your purchase was for a
virtual, digital, or intangible item. Indeed, our PayPal Purchase
Protection only covers claims involving physical items that can be shipped
and tracked. Payments for intangible, digital items or services are
therefore not covered.

We encourage you to work directly with your seller to resolve the problem.
You'll find their contact information on the Transaction Details page.


It's nice to know Paypal doesn't protect buyers any longer and they are now protecting scammers. I am pissed beyond belief that Paypal is taking this stance. So basically what Paypal is saying is that if we buy anything that is not a PHYSICAL ITEM, we as buyers are fucked all day every day. :disgust:disgust:disgust:mad::mad: What a bunch of bullshit. This basically protects the scammers because they don't have to give us what we pay for, as paypal protects them. :mad: I didn't pay from my credit card so I can't do a charge back either. :(

Paypal made it very clear that they cannot protect non tangible purchases, for your information if you lie about the purchase and say you bought a jacket or something it works usually :D

If you funded your paypal account with a credit card then you can file a dispute with your credit card company. You will lose your paypal account though.

I've had customers (scammers) in the past, that I did design work for, they received the work / used it -- but charged me back on Paypal and Paypal gave them their money back, even though it was digital design work.

I would call your bank!
Next time you hire a programmer I would use escrow through paxum or if via paypal make sure you put it for tangible goods like all work on a CD

Item: CD OF PHP/DEV

and make sure you include your shipping address. This will back you up.

Unfortunately, I paid with funds from my paypal account buddy so I have no recourse in that regard :(

That's interesting because according to Paypal's BS reply, they shouldn't have given your scammer back his money sice it was digital "design work". Just shows you that their policy is total crap.

I can't call my bank since I paid with funds from my paypal account :( I will definitely have to keep that in mind about a CD good. That's a good way to protect ourselves :thumbsup

I didn't realize that website wasn't non tangible. I thought it referred to downloadable products like you buying a song from the itunes store. Things like that. Haha have to keep in mind with the jacket thing. :thumbsup


There might be a silver lining to this story, Brandon contacted me yesterday afternoon so hopefully he will follow through and we can get this project completed. Keeping my fingers crossed.

Still pissed with Paypal though. It's an idiot policy that opens the door for pure scammers to rip off people. Here's an example:

A scammer could theoretically open a paypal account, offer something for sale digitally (fake software for example) collect payments through paypal and then not deliver it and Paypal would stand behind the scumbag and protect him. That is messed up, scammers in Nigeria can quit with their old scams. Just open a storefront online store and scam people "legally" with Paypal as their partner protecting them :mad:

if you have a Financial Ombudsman Service in your country, file complaint about the paypal order and they will deal with paypal , and try and help you as paypal must relook into the case if they are contacted

Paypal basically is becoming a haven for scammers now. I'm not surprised you are having problems adultwpthemes with Paypal too. I keep reading everywhere the horror stories from people like you and me who have been fucked over by Paypal and their stupid policies that basically protects scammers. Hope you get switched over to Zombaio soon so you can stop losing money with Paypal.

I sent a followup email to Paypal to explain that I even though it was for a website, I was supposed to receive it in a "flash drive/CD" to be shipped to me so technically it would not be an "intangible good" as it's something that is physically in my hands but the ass clowns

I absolutely love the last line by this clowns, I can see some guy being pissed off enough that he/she drives down to the person's house who scammed him, and killing him or doing him enough harm. That will be absolutely priceless because he can show that stupid last line of Paypal's response and everyone in the world can see how stupid and idiotic that last line was. Thanks for rubbing it in you Paypal clowns. Tell me now why people would use your fucking service if they have no protection against all the things you listed above that is not covered in your laughable "Purchase Protection"? :mad::mad::mad:

ps. "Custom made items".... So this would include a gold bracelet you buy from Ebay with an inscription of the person's name inside the bracelet. That would be "custom" so ooops you are shit out of luck if you bought it and you received a fake gold bracelet. Holy crap, does Paypal just change the rules as they please and add new things as they see fit?
