Chicago enacts "Netflix" sales tax

Chicago Cloud Tax May Keep Startup Trunq From Launching in Chicago | Chicago Inno

I don't know how this is going to pan out.

Business may find it inadvisable to have Nexis in the city of Chicago. But under this law: Subscribers to video streaming service (e.g.; Netflix, huLu, Amazon ...) would have a 9% tax added to their invoices if legal Nexus of the provider exists or may incur liability for paying use tax on digital services ... Sound familiar?

Seems like Chicago is trying their best to make sure business steers clear of the city to avoid Nexis status...

Not this argument again.

Almost every state has had a sales and USE tax for decades. This just sounds like an aggressive way to actually get it.

Taxing online sales is a nightmare, and with more business being done online there's a hard choice to make.

Do tax collectors, apply taxes or cut spending, or borrow more money to pay the bills?

Before you plump fr cutting spending, would that affect services you rely on and if so how? Police, fire, paramedics, roads, etc.

What's the choice? When you sign your state income tax forms you have either complied/paid or perjured yourself.

Yea but legally the state can only collect taxes on things which are sold with-in the state. Example if you live in FL, you have to pay taxes if you buy computer parts from Tiger Direct, because they are based in FL. On the other hand if you buy from New Egg you pay no taxes.

Incorrect. It's right there in front of you!

"If an out-of-state seller fails to collect sales tax, it is your responsibility to comply with Florida law. You must submit payment directly to the Florida Department of Revenue. This payment is required by section 212.06(8), Florida Statutes. You can file and pay use tax online or complete an Out-of-State Purchase Return (Form DR-15MO). If the tax owed is less than one dollar, you do not have to file a return."

This is bullshit. What's next? They will start charging people for listening to the radio because the airwaves are transmitted "through the clouds"?

"Sales and Use" taxes have been around for decades ....

Just because some of you have shitty accountants or have never been audited doesn't mean you haven't been wrong every time you signed your state tax returns.

You're an internet professional and you don't know California Tax statutes regarding online purchases? You have an accountant you have either lied to or need to replace. Every time you sign a State Tax form you commit perjury?

This law has been in effect in California since 1935.

Fuck Chicago!

You could give me a house there and I would piss on it and then burn it down.

Barry-xlovecam 07-16-2015 06:50 PM

You are missing the point -- most states have a sales tax on merchandise, software is considered merchandise ...

This is a city sales tax in addition to the Illinois state sales/use tax rate? 9% -- This tax only is on digitally delivered ''services'' e.g.; ''entertainment''.

Use tax is due annually in this state with a sales tax but on merchandise only and not services or labor:2 cents:

To the best of my knowledge, New York State and Washington State are the only states that tax all labor and services ...

Chicago has only classified ''digitally delivered entertainment'' as taxable.

Y'know, there are more than a few countries which DO require licences for radio and TV receivers. One way to detect illegal receivers is with a van full of sensitive equipment that is able to detect the radiated signal from the receiver circuitry.

Sounds like tin foil hat stuff? Nope, it's real.

Heard about Netflix deal few weeks ago on da radio. They said Netflix will comply. Already have crazy cigarette taxes along with bottled water, pop, etc... taxes. Our state tax goes to 10.25% January first so they can pay some pensions.
