Is it ok to use a webcam model's name in a review site? I notice some chat rooms say stuff like "don't use pics or videos". I get that. But some are saying "don't mention me on a site".

No it's not a copyright violation.

In the context of a review site, using a screenshot would also not be a copyright violation.

However it may be a violation of the terms of the affiliate program, so you should probably be sure of your position before you embark on doing it.

Chaturbate, in particular need to clarify this - There are some great models that I want to promote that say I can't use their stuff...

This did put it up very well. It is your right to do so in review (generally), but you may also have done more restricting contract with the cam affiliate program.

If it's not libelous toward the model or the cam site it's protected speech.

A positive review or a critique -- either way.

We have ''official'' image content of most models available to affiliates. A ''good - faith (not a libelous action)'' review is not an infringement of a model's right of publicity or privacy, IMO.

Assuming US model... It might be a violation of her common law trademark rights or the Lanham Act if she actually TM her model/stage name.

It would be nice to have some clarification on this - How many times do we need to ask?..

there is a difference as to what is protected under free speech and what you can do as a affiliate though.

It depends about the contract you have made with the affiliate program (if there is any) and the country you live in. And with less meaning about the country of the model/ program.

In more complex situation there are at least 3 parties and 4 different countries to deal with. Quite hard to give any conclusive answer that covers all situations. But in general there is freedom of speech in western countries. For example I can write Coca-Cola in here, despite the fact that Coca-Cola is a trademark. Though someone can always try to sue me for that, but good luck for that (not really; bad luck for that).

You can also try to sue me for saying this. I mean "this". I don't think it will get very far, but nothing prevents you from trying it.
