dubose had been arrested 60 times prior to this, he of all people know he should have complied with the cop, instead he tried to start his car and getaway leading to the cop fucking up.

Should the cop have shot him? Of course not. But if a suspect is refusing to answer questions and then refusing to get out of the car, the hand goes on the gun. The moment shit goes south the gun comes out and then what ever happens happens. The moment he started that car and started to drive away was the moment it went south. Seems to me like the police officer was hit by the police car; That's assault with a deadly weapon.
