Fake Celeb - How to do it offshore?

Hey guys,

I'm a 3D artist, and am able to make Celeb lookalikes via CGI. It's not perfect, but I've validated the idea, and it looks like people will pay for it.

Just a few things:
- I am from Australia, but would like to do this 'offshore'. It looks like what I would be doing *should* be protected under parody laws, but that wouldn't stop celebs suing, which would eat up all of the profits to defend.

1. Should I register the domain via internet.bs - is this still the standard for this kind of thing?
2. Who should I host with?
3. How would I receive payments - would I have any hope with CCbill or Instabill? Are there other alternatives?

Thanks in advance guys, really excited to get to work on this project :)

Have luck making enough "profit" to pay for the free half-hour consultation with your lawyer. :1orglaugh

You WANT the celebs to sue you! They wouldn't have a case because it is indeed protected speech, and you would get more traffic than God as a result of them suing you!

Why? Too hard to get paid? That's the biggest issue I foresee.

If you stare long enough, you can start to see the resemblance.

They're far from perfect, they would improve if it was worth my time. But that site validated very strongly, huge response from plugrush traffic.

I think with your amazing product you should use IBILL, :2 cents:

Mr. P-Nerd (previously known as Mr. P-Body!), why oh why do you have such bitter indignation for Australia? Like, I can never tell if you're joking about it or if you truly loathe Australia and Australian people?

I spent 6 months there and the place and the people were lovely!

davidclickpapa 02-17-2016 02:21 AM

now do Danny DeVito!

Talk to a lawyer; This goes to 'Right of Publicity' and not copyright parody. While public figures, like politicians, do not have certain rights of publicity -- political cartoons, etc. -- private persons -- like Paris Hilton do have 'Right of Publicity'. This is not copyright law, it is common law. The following would apply in the US state of California, jurisdiction may be an issue.

Ninth Circuit Lets Right of Publicity/Parody Case Go to the Trier of Fact
Quote:

The test is then whether the product containing the celebrity's likeness is so transformed that it has become primarily the defendant's own expression rather than the celebrity's likeness. When the art of skill and talent is "manifestly subordinated to the overall goal of creating a conventional portrait of a celebrity so as to commercially exploit his or her fame, then the artist's right of free expression is outweighed by the right of publicity." Comedy Three Productions, Inc. v. Gary Saderup, Inc., 25 Cal.4th 387, 407 (Cal. 2001).
Talk to a lawyer and find out just how this might apply and could these courts somehow get jurisdiction ...

Mr. Nerd?

2MuchMark 02-17-2016 07:16 PM

Cool idea, but Why are you sending us to a waybac.org archive of your site instead of a live site?

Regardless, you might have some uphill battles.

First, the images don't look that much like the celebs you want to "parody".

Next, Like all low-budget CG (and even some high budget CG), The Uncanny Valley will freak everyone out. Uncanny valley - Wikipedia, the free encyclopedia

Finally, even if you and technology gets really good, you will undoubtably face lawsuits from the people who's likenesses you are trying to mimic.
