FSC: 2257 Ruling a Huge Victory for Free Speech

AVN - FSC: 2257 Ruling a Huge Victory for Free Speech

I've shot content since 1986, and this is very welcomed. Leave it to the US Third Circuit Court of Appeals to get the 1st Amendment right!

To think that producers actually committed suicide when the witch hunts started in 2006!

Producers quit the business over lack of compliant records prior to 2006, and that was 3-5 years before the Tube sites put even more out of business by giving away porn - without regard to 2257 IDs.

It's been a long, long 10 years! July 2006, if I recall from posts here, and GWW.

Even though 2257 was a huge political abuse of power by US Republicans, I'm finding websites where we can "sell" content, those sites that don't just give it away free as "advertising," are coming up with even more strict rules than 2257 ever had!

Are other countries coming up with these rules??

* One site wants the model's ID to be valid as of "today's date"! 2257 was about an ID being valid on the "date of shooting". Since most Passports are 10 years, and US State Driver's Licenses expire in 4 to 5 years, that rule means a lot of good stuff shot during the 2008-2012 Recession, when models were hot to look for work, are not going to be accepted anymore! And there's NO legal "2257" reason!

* Sites are wanting a photo of the model holding their ID to their face. Not required by 2257.

* A site wants a photo of the "reverse side" of a model's ID. Not required by 2257.

Yet, sites claim that their rules are due to US 2257, not because of a British law, European Union law, or any other country's law!

Very frustrating.

Go by the AVN article quoted. There's also a XBIZ article on line. Or the FSC website. You can also become a FSC member.

Most laws act as 'baselines'. As long as additional terms do not conflict with other laws (privacy, non-discrimination) those terms MAY exceed the laws.

If your terms are excessive, abusive on just nutzo -- buyers or sellers will not do business with you.

This is called a free commercial market -- move on, there is nothing to see ...

I will give you one example: Most adult webcam broadcasters will require of applicant webcam models for an image of their ID held next to their face for anti-fraud and security reasons. We do and we are not in US jurisdiction. We are free to set our own terms (in compliance with local laws and EU Directives) for this type of contract -- our terms are customary in our industry however.
