so PornHub, why would I want you to own my content & give me no permissions to reproduce my content?

But.. Those are amateur videos, like cell phone videos, that wouldn't legally be allowed normally because of 2257 and other things that individuals aren't going to be doing.

You are not transferring any ownership of the content only agreeing to Pornhub's exclusive use ''on any free user-generated sites or platforms''.

What exactly ''on any free user-generated sites or platforms'' means is rather vague -- it may not be very binding. For example, if you had your own forum as part of your business -- you may not not be able to use that content only verbatim in its entirety -- big loophole that you might be able drive a truck through.

That is the way I see the intention -- without going into Pornhub's rational in the matter.

but as many users, I post my clips and partial movies if not full on this tube and others like xhamster, and already done. I'm certainly not going to remove any from other tubes.

You do realise that if you make two versions of one video and one is on Pornhub and the other is on XHamster then there won't be an issue ?

That is actually happening already, even in mainstream.

Pornhub's only realistic recourse is to cancel your account, not pay you and they might have established a right to the content and its use if this agreement (stipulation) is breached.


It's a real POS piece work but there may be a real ulterior motive here.

This will certainly be the problem. Don't see how they can 'win' anything when claiming they own something uploaded by someone who didn't own it in the first place.

I can understand if maybe, Gary & Nathalie were going to provide them content in exchange for traffic to their site TEMPORARILY, but this wording is PERMANENT. What if no traffic is provided or if the deal just doesn't work out? Gary & Nathalie should then be able to end this deal, re-gain their rights to their content, and look for someone new to work with, no?

A serial thief is going to send DCMAs to sites where the owner of the content has uploaded it. Could it be more wrong?

Also, how do they know the person submitting the content is the owner?

after speaking with Brett from PornHub, seems the above is the case. PH are simply offering DMCA especially to models uploading specifically to PH, scanning the top 50 sites and issuing the DMCA if need :2 cents:

To clarify about the program this is an optional service we are providing as part of our amateur payment program. this is geared to a portion of our users in the program who upload exclusively on Pornhub already and have requested help protecting their content from appearing on other free sites where they aren't getting paid. If you are someone that is already uploading your content to other free platforms this program is obviously not right for you. I'm fairly certain dmca agents do not require ownership of content to act on owners behalf. The warning light box popup is misleading to put it mildly.

I already have enough issues with DMCA complaints to Google about legally obtained affiliate promo content.

And how is that going to work for THEIR affiliate content? They offer dumps for people to use on their tubes, is that going to be a similar headache?

I already have that problem on Youtube. :( It's solved for now, but that was a real pain in my ass.
