The CEO of Backpage, a website that has been accused of allowing ads for child sex trafficking, was arrested Thursday in Texas.
Carl Ferrer, 55, was arrested in Houston after landing on a flight from Amsterdam, the attorney general of Texas announced.

I think it is going to be really interesting to see how this all plays out, as I imagine that Carl Ferrer will have the resources to mount a significant defense.

I would expect that the defense would point out that users must agree they will not use the site to violate any laws, and show how ads that they find are for an illegal service are removed. Further, they have legal precedent that can point to where courts have ruled that website operators are not responsible for the criminal conduct of their users.

The prosecution will have to try to show that Carl Ferrer was aware of the criminal use, and allowed it to continue, taking no steps to prevent it, or that the primary purpose of the site was to facilitate criminal activity to begin with. As these are criminal charges, the burden of proof is quite high.

I would probably choose not to go there if i was making that much and must obviously be on the radar.

The estimate is likely overvalued as is normal for prosecuters to do when filing charges, but there are also 49 other states, three of which are significantly large. Plus Canada and the rest of the world.

They were probably making closer to $15m - $20m since escort ads are not the only thing they charge for.

The US Senate has been investigating Backpage for years. Ferrer basically told the US Senate to shove their subpoena up their ass, he's not showing up to testify and he's not giving them the docs they are asking for.

This is what happens when you try to tell the US Senate to F off...

Harris is running for Senate and this is a political move. California is going to have a very very tough time making this stick. And he probably knows this is an arm twisting technique. He's got a some of the best lawyers working on this case.

The Sheriff who requested that VISA/Mastercard stop doing business with Backpage was sued and Backpage won. Even the USSC didnt take the Sheriff's appeal...they denied cert.
