Backpage advertising prostitution in the USA is in violation of most states' laws. Sex trafficking adults and children for prostitution is in violation of most states' laws and when you cross a state line in interstate commerce it is in violation of https://www.law.cornell.edu/uscode/t...-I/chapter-117 USC 18 Chapter 117 Quote:

I think it is going to be really interesting to see how this all plays out, as I imagine that Carl Ferrer will have the resources to mount a significant defense.
I would expect that the defense would point out that users must agree they will not use the site to violate any laws, and show how ads that they find are for an illegal service are removed. Further, they have legal precedent that can point to where courts have ruled that website operators are not responsible for the criminal conduct of their users. The prosecution will have to try to show that Carl Ferrer was aware of the criminal use, and allowed it to continue, taking no steps to prevent it, or that the primary purpose of the site was to facilitate criminal activity to begin with. As these are criminal charges, the burden of proof is quite high. |
Did he travel to the USa knowing this would happen? Was he aware of the possible arrest?
I would probably choose not to go there if i was making that much and must obviously be on the radar. |

It was only $2m for California. The estimate is likely overvalued as is normal for prosecuters to do when filing charges, but there are also 49 other states, three of which are significantly large. Plus Canada and the rest of the world. They were probably making closer to $15m - $20m since escort ads are not the only thing they charge for. |
I wonder how much Fling was paying them, since they were the biggest customer and whitelisted to post links in the escort ads without removal.

Site is still up in the USA for me using a US IP
Los Angeles - escorts - backpage.com The three principals are sitting in jail waiting to be arraigned today or tomorrow. [asuming they all have been arrested by now?] https://oag.ca.gov/system/files/atta...edact ed.pdf? ^arrest warrant |
Is an election coming up in Texas? Sounds a lot more like it is about vote getting than any REAL concern about ... well ... anything at all criminal.
|
So seems like he would have known and came back to stand tall and fight the legal battle.
Guy has balls |
Kamalla Harris is the DA and she is running for Senate.

Backpage won the dismissal of a similar case last year in the US District Court for Massachusetts

He (Ferrer) will probably get a walk on this. (After a few weeks in jail -- denied bail "flight risk"?) https://en.wikipedia.org/wiki/Sectio...ent_and_minors |
The US Senate has been investigating Backpage for years. Ferrer basically told the US Senate to shove their subpoena up their ass, he's not showing up to testify and he's not giving them the docs they are asking for.
This is what happens when you try to tell the US Senate to F off... Harris is running for Senate and this is a political move. California is going to have a very very tough time making this stick. And he probably knows this is an arm twisting technique. He's got a some of the best lawyers working on this case. The Sheriff who requested that VISA/Mastercard stop doing business with Backpage was sued and Backpage won. Even the USSC didnt take the Sheriff's appeal...they denied cert. https://www.washingtonpost.com/polit...506_story.html And Backpage is estimated to make about $150 million a year... Here's a 196 page US Senate report on Backpage if you have an hour of your life you dont need... http://www.portman.senate.gov/public...f-736d083917c5 |
I tend to agree with Barry that he will walk, but its looking more like a witchhunt with congress getting involved and multiple state agencies on his ass.
If they really had a case wouldnt the site be shut down like the online casinos were? Looks like business as usual at Backpage. |
This is a joke right
|
|
I am sure he was involved with the pimping but at the end of the day the charges are for money laundering. I bet he was stealing from the company now they are fuckin his image up for life.
