The French government is considering setting the minimum age for sexual consent following a controversial decision by a jury to spare a man accused of raping an 11-year-old girl. The verdict has sparked a public outcry and calls to revise the law.

The bill, if adopted, will set a benchmark in French law on sexual violence, as it will for the first time define the age limit under which any sexual intercourse with a minor is legally considered rape.

?The question of the age below which the minor?s consent is presumed not to exist is crucial, because there are obviously extremely shocking and unacceptable situations,? French Justice Minister Nicole Belloubet said, as cited by RTL radio.

Regarding the age of consent, Belloubet said that the age of 13 ?is worth considering,? while noting that the final decision in each case should lie within the discretion of the judges.

Marlene Schiappa, a junior minister for gender equality, argues that it should lie somewhere between 13 and 15 years.

?Below a certain age, it is considered that there can be no debate on the sexual consent of a child, and that any child below a certain age would automatically be considered to be raped or sexually assaulted,? Schiappa told BMF TV.

The need to amend the law was brought to light by the jury verdict in the case of a 30-year-old man who, back in 2009, allegedly lured an 11-year-old girl into a sexual relationship. Last week, the man, a Cape Verdean native, was tried by a jury court and acquitted after prosecutors, who were seeking eight years in jail for the defendant, failed to prove that the sex was non-consensual.

The age of consent in France is 15, as specified by Article 227-25 of the Penal Code, which reads: "The fact of the commission without violence, constraint, threat or surprise of a sexual offence by an adult on the person of a minor under fifteen years of age is punished by five years' imprisonment and a fine of ?75,000."

They want to charge these people with rape but can't.. so change the law.

It wasn't an issue until the muzzies arrived and took advantage of the lack of strong laws.

I was 13 and I turned out alright. I think if they are going to set the age that low they should put something along the lines of it's legal for people 13-16 but have the age set at 16+ for people over 16, so adults can't take advantage of minors.

These statutory rape laws historically started to stop seduction of naive, innocent children by predatory adults. In most of the early laws, including that of Illlinois, it was necessary for the state to prove that the child had been of previously chaste character. As late as 1976, it was a complete defense in Illinois that the female was a prostitute. Illinois law took the position that the horse was out of the barn in that case, that there was no longer anything to protect.

Over time, the political activists took the position (not concurred with by the medical health professionals defining pedophilia in the DSM III and IV) that it was perverted for a man to be attracted to females under the statutory age of consent and that the females were all victims of one or another male sex organs, and so the limiting language or the defense of prostitution were removed. So the law is now more absolute.

The age of consent varies in complicated ways around the US. 16 is the age in Michigan, 17 in Illinois, and 18 in Wisconsin. In some states, the difference in age between the parties makes a difference, in others not at all. In most states, it is an affirmative defense that the adult reasonably believed the child to be an adult. In others, including Florida, this is no defense at all, not even if the child is brandishing a phony ID that tends to establish that she's 18.

Until very recently, Switzerland permitted prostitution at age 16 and online ads for massage parlors advertised such ages. International pressure caused this to change. US Federal law criminalizes international travel by US passport holders for sex with persons under specified ages, regardless of whether such sex is legal at the place where it takes place. And this law is enforced.

There is nothing close to uniformity among the nations or states in this sensitive area.

But, germane to the purposes of this forum, understand while that it may be entirely legal to commit consensual sodomy with a 16 year old for days on end in some jurisdictions, one photograph of her breasts is enough to put you in prison and on a sex offender registry for the rest of your life.

Fake! The Age of Consent in France is 15 years old and rises to age 18 when the older party is an ascendant or a person having legal or factual authority over the victim like a teacher.
