They incorrectly assumed it was ok that their witness sit and listen to everyone else's testimony before they testified. It became two wrong being righted. The judge was caught off guard knowing the witness was sitting there.. if the defense wanted they could have jumped at the opportunity. If BV they find issue with the testimony they still can.
