Flake is very necessary. It is 48 For 47 Against. Flake, Collins, Manchin, Mikulski , and Heitkamp undecided.
The floor vote needs TWO of those for Kavanaugh to be confirmed. Flake will NOT vote yes without FBI. He is retiring. Manchin may vote for, but Heitkamp will probably not. That leaves Collins and Mikulski. If they supported Kavanaugh they would have said so. They have not. Doing nothing will not change their minds. Right now, Kavanaugh is dead in the water unless Flake's demands are met. He is a loose cannon, no one knows what he wants. Probably to fuck Trump in the ass, literally. |

We are talking about a lifetime appointment to our highest court. We need to be positive. In fact, when it comes down to the final vote, it should be anonymous. |

The FBI can't just open a investigation into a SC nominee because a Senator wont vote yes unless they do. It doesn't work that way, added to this, they wont start a investigation with a imposed 1 week deadline. That's not how they work.. This is all just Flake not having balls enough to just say no, so he called for a investigation as a cop out so he can have an excuse to Republicans who will send him death threats anyway.. |

This is so dumb. Kavanaugh is clearly not qualified to be on the SC. Stories of his past asside, he lost his temper during the proceedings, he refused to answer some questions clearly, and he believes there's a conspiracy involving the Clintons to stop him. Geezuz christ. There are plenty of other people more qualified for the job than he is. Trump wants him in to protect his own ass, thats all.

So here's the deal apparently.. His confirmation IS going to be voted on tomorrow.. The "FBI investigation" is really nothing at all.. They are going to do the same thing that's already been done.. Interview everyone and put it in the file.. That's it.. They make no determinations whatsoever.. If the Senators decide to make referrals based on already given testimony from there they can.

^^This I'm unclear on; I think they'll simply seat him if he is confirmed, why does this matter? I suppose because cases have to be remanded where there is a 4-4 vote. Are there any big cases in the first few days?

Jeff Flake is the only Republican willing to do his job. It's a shame his courage comes from the knowledge he won't be in the Senate for very long.

They will push the courts to change the Constitution by underhanded interpretation. They need to put the rules back on that were in place for the house and senate in the 80's and require at the same time that it takes a 3/4 majority to change them thereafter. It would go a long way in reversing this crap ! But, why not require a 2/3 majority for SCOTUS and require that the full senate has to post a vote on the floor for the seat in 60 days. |
