It's easier to show you guys than to explain more

Then when I called them out on this 2 weeks ago, they apologized and removed the pages... so I decided to give them a pass...

Then 3 days later they had the links back up

SO I again emailed, and they again removed

NOW today, I see that they are still keeping the urls alive that have my website names in them. Still trying to catch people from google looking for a discount to my sites.

So... Someone is offering a special on a website? And? The problem is? Affiliates make less money. Well, yes, that is how it works. The affiliate gets a percentage of the sale. The affiliate program sets the price of the site, and the affiliate gets a percentage. That's always how it works. Some of the more advanced larger programs might be able to allow the affiliates to set the price of the site, but if not the affiliates are at the mercy of the affiliate program who sets the price.

Result? We are using your name and they get the sale. Had somebody asked me about this first I would have schooled them on business 101. You simply don't do this. Reviews could/should have been written to include what happens in the members areas through text. Links should have remained, sending each site to the site recognized in their respective reviews. Really simple to me. It wasn't to my employees.

Was what our team did bullshit? Yes. I totally agreed with your side when this was brought to my attention, Jim. When I saw the setup on our side, using your hard work (making Nebraska Coeds into a brand) used to send the surfer to the NVG deal, I had a heated discussion with our employees and Rasmus about it. It really irked me because it is business 101. You just don't do that.

Some time around the end of May in 2016 we signed up to Nebraska Coeds and began promoting them. Things went swimmingly. One of those anonymous relationships whereby the affiliate and the affiliate program have no interaction because everything is working as it should be.

Sometime in December 2018 an employee who was in charge of editing reviews noticed that the members area's of a few programs where in some way combined. So that buying Net Video Girls gives you access to Nebraska Coeds, and buying a membership for NC gets you NVG. That employee had shown sufficient growth in their training and had never made a boneheaded move like this before, so we let this person off the chain to handle things on their own.

This employee combined the NC reviews into NVG. This meant that if you came to our site and clicked on NC, you ended up going to NVG to actually make your purchase.

I explained to Jim that I also felt this was a dumb move and we handled it with a ration of shit while I was on vacation. When I got back from vacation I read the Emails from Jim and was taken back by his accusatory stature. Nobody here knowingly tried to rip him off and the amount is laughably small. Like $350 per month is my guesstimate of how much was lost due to this error.

I just got back home. I have scanned our DB's and removed all mention of his sites from them. Which I was planning to do without him going ape shit from the very first email, threatening litigation.

We will gladly send you the $350 x 6 months of error. Not a big deal. This is such a small amount of money for somebody to begin with, "lawyers are involved."

What I did offer him was to forget this issue and put it back to him getting the credit for the sales. He went even more ape shit demanding that I take his shit down now and that he was going to blow this shit up in my face. Really? Over such a small amount of money?

I guess I just don't understand the logic.

If it were me, I would have said, hey, put the shit back to us both making money, then send me a check for the money I lost while you had it in error. Then if the response was no I would go apeshit.

Our company has always worked with programs to positive outcomes when there is a problem. This is the first time in 4 years of business that we've had something like this happen and that the owner of a program came out swinging instead of just asking us what is up.

it's interesting how people interpret law the way it suits their needs. once i've got a notice from a well-known sponsor back at the day expecting me to take their links down like yesterday. all without even notifying their affiliates about any changes.

what does the law actually say: replying to a DMCA notice has no deadline. the default setting for most of these applications is 14 days though they can range between 7 and 30 days.

apart from the URL in question, the most important part of the DMCA notice is:
"I have a good faith belief that the use of this material in such a fashion is not authorized by the copyright holder, the copyright holder's agent, or the law;"
