Marshae Jones was five months pregnant when she got into an argument on a December afternoon last year outside a Dollar Store in Birmingham, Alabama. The argument escalated and the 27-year-old was shot in the stomach. Jones was rushed to the hospital and eventually recovered, but the shooting ended her pregnancy. Police initially charged the shooter, 23-year-old Ebony Jemison, with manslaughter for firing on Jones in what police say was a dispute over the man who was the father-to-be, but the charges were dismissed after the grand jury declined to indict Jemison because she was acting in self-defense. On Wednesday, however, an Alabama grand jury instead charged Jones with manslaughter for the miscarriage. Why? “The investigation showed that the only true victim in this was the unborn baby,’’ local police Lt. Danny Reid said at the time of the shooting. “It was the mother of the child who initiated and continued the fight which resulted in the death of her own unborn baby.” Marshae Jones is now in jail.

ALabamastan is perfect example of what happens with brain drain. A lot of the facts of this case haven't been released yet so I'm withholding judgment on this one for now other than to say if you feel an unarmed 5 month pregnant woman is a threat to your life and you "stand your ground" you're a fucking idiot and shouldn't have a gun.

Mothers who take drugs while pregnant, etc. are routinely charged with abuse, murder, etc.

I have a feeling had she gave birth then chose not to vaccinate her kid and it died from some preventable disease they wouldn't be charging her.

They didn’t charge the shooter. They blame the mother for the death since she fought the other woman. What the fuck??? I thought the laws were fucked up but this takes the cake.

If a man wants his pregnant woman to abort the child and she refuses, he can legally shoot the unborn child dead and no charges will be filed. Attempted murder seems a good thing to charge someone with if they shoot a pregnant woman in the stomach!

The Yellowhammer Fund, which helps women who are unable to afford an abortion or the costs of travel, said Jones' indictment is ridiculous.

"Marshae Jones is being charged with manslaughter for being pregnant and getting shot while engaging in an altercation with a person who had a gun," Executive Director Amanda Reyes said in a statement.

"The state of Alabama has proven yet again that the moment a person becomes pregnant their sole responsibility is to produce a live, healthy baby and that it considers any action a pregnant person takes that might impede in that live birth to be a criminal act."

According to Alabama law, manslaughter happens when:

-- A person recklessly causes the death of another person; or
-- A person causes the death of another person under circumstances that would constitute murder, "except that he or she causes the death due to a sudden heat of passion caused by provocation recognized by law, and before a reasonable time for the passion to cool and for reason to reassert itself."

Manslaughter is a Class B felony, punishable by up to 20 years in prison.

Jemison, the accused shooter, initially faced a charge of manslaughter, AL.com reported. But a grand jury declined to indict the 23-year-old.

Neither the Pleasant Grove Police Department nor the Jefferson County district attorney's office have responded to CNN's requests for comment.

If you argue with someone, you don’t normally expect to be shot. The shooter intentionally killed the unborn baby rather than shooting the mother in the head to kill her. She caused lifelong pain to that woman.

The mother should be charged with endangering the life of an unborn child. No one knows if the child would have lived if not shot. Miscarriages, SIDS, premature birth, etc. She endangered the unborn child and the guilt of that is forever. Charge her with stupidity err a minor crime, mandatory counseling, give high school kids a lecture on fighting while pregnant. Let her tragedy teach others about consequences.

Pregnant women shouldn’t be in cars, walk in public, go shopping, stay at home, go to school or eat food.

Huh?? Cars have accidents, people are hit by cars walking, people can be shot in stores, electrical malfunctions in houses cause explosions, school students are shot and food can have salmonella.

According to Jemison, she, Jones, and the baby’s father worked together at a warehouse in Royal Oaks at the time of the shooting. She said that Jones would often get suspicious when the baby’s father — who was a supervisor — would talk to new female employees in the warehouse.

Jemison, who was a temp at the warehouse, said that she talked to the man only in the capacity of her work and that Jones had never confronted her directly about it.

But, Jemison said, on the day of the shooting she and three of her friends went to the Dollar General store during their lunch break when she saw Jones with four of her friends approaching her outside the store.

An altercation broke out, and Jemison claimed that Jones grabbed her hair.

Jemison said she then fired a single shot from her gun toward the ground that was intended to be a “warning shot” because “there was too much going on and just too many bodies.”

“My shot wasn’t to hurt anybody,” Jemison said. “It was just to get everybody to leave.”

Jemison said that after she fired the shot, everybody left in their respective cars. She said she only found out that she had struck Jones and killed her unborn baby when a detective showed up at her house after the shooting.

So if I instigate a fight, and someone dies, who is at fault? Me or the person defending themselves?

You're all stupid. There's no such thing as a "pregnant woman."

What you think of as "pregnancy" is simply the reaction of someone's body (who identifies as female) to a foreign irritant (usually sperm) put there by someone who identifies as male.

As a defense mechanism, the body forms a human-shaped mass of protective cells around the irritant. Once the mass of cells reach a sufficient size, the body will be able to push on it, in order to expel the irritant, along with the clump of protective cells enveloping it.

The expelled mass of cells may appear to be alive and appear to be in the shape of a human. It can cry, be fed, poop, and sleep just like a normal human.

If one so chooses, this mass of cells can be nurtured into adulthood. Or experimented on, or dissected alive, or tortured to death in endlessly interesting ways to make viral videos for Youtube.

Read today about the prosecutor not being sure if they are charging the pregnant woman with anything. The decision to charge her was met with anger and criticism so they need to discuss it more.
