Adult Industry Fucked? US Gov't SBA Loan Requirements
 
So I go to apply for the Covid-19 relief loan for small businesses being offered by the US Government:

But then I see this as a requirement for applying for the loan:

"Applicant does not present live performances of a prurient sexual nature or derive directly or indirectly more than de minimis gross revenue through the sale of products or services, or the presentation of any depictions or displays, of a prurient sexual nature."

So we in the Adult Industry need not apply? Or does it depend on the definition of the word "prurient"? Are they talking about sex workers (strippers, hookers, cam girls)? And what the fuck does 'more than de minimis gross revenue' mean?

Maybe the GFY legal eagles can chime in on this one please!

It all depends on your tax status and what you say you do. If you say your occupation is hooker or stripper you are probably screwed and should probably consider a new accountant.

The layman's explanation is basically hotel/motel franchisees, convenience stores and newsstands are exempt and you're screwed. But nevertheless, even if you did have a qualifying business, you're weeks too late applying for a piece of the grant money.

They may extend the period for applying since the system crashed with so many applicants. The loan portion would still be good either way.

I get about newsstands, etc. But how about online paysites?

So many of those online (mainstream and adult) companies went off shore - They will be kicking themselves - I wonder if it was worth it in long run...

Always have just one mainstream website. You can point it out to the general public and bank officials without fear of rejection.

There are tons of mainstream affiliate programs around. I needed a few for a website but many pay just 3% while others pay 40%. The ones I want have such strong guidelines and expectations that I stuck with Amazon. Less work and maintenance.

Good advice! I actually do have some mainstream sites. I asked my accountant for advice, too.

Is your company actually registered as an adult company? When we started 10+ years ago it was impossible (in the Netherlands) to get a bank account with an adult business, changing description to entertainment/web development solved that

I believe we are registered as an entertainment and media company. I am also a published journalist so my writings fall under the term "mainstream media". :)

I used many banks in life and not a single bank ever asked me what i do. Tho, probably because i am registered as self-employeed and not as corporation.
