Hello,

I received my first DMCA from a chaturbate model. I don't store any content on my server. If she is not listed in the chaturbate API, she won't appear on my site. If she is offline, that unique URL with her username in it is then re routed to another page with a list of chaturbate models that are online.

How would I even take action on this? Isn't there a way she can talk to Chaturbate and remove herself from the line feed?

Any help is appreciated!

If you promote stolen content you are just as guilty as the thief is. So delete any such content.

Funny, I received one the other day as well from a cam model on one of my embed tube sites. It was not even a stolen clip from a show that got embeded, it was a video from the models verified Pornhub channel, meaning she was making money on all the views!

I don't think a lot of them understand the concept of Whitelabels/embed tube sites. There should be an opt out feature for them for sure. If someone ripped a cam show and uploaded it to a tube I can understand that, but to DMCA over a video that is actually making you way more money than it's making me makes no sense to me.

If I were you I'd put up a DMCA page with a contact email. 90% of the time they will just send the notice to your email directly if they can find it, which is helpful as it won't get the host/cloudflare/or the registrar involved.

Neither models nor studios or dmca agencies have access to the promotional material. I think it's part of the problem and chaturbate could probably make these available to them quite easily. Ideally models should even be able to upload additional promotional material themselves.

That's not always the case. You give up certain rights by using a service (Chaturbate, in this case), If it's part of their terms of service, (as a model) you've agreed to this...

I will agree with you partially. If the model was hired and PAID by somebody incl. Chaturbate to perform, then of course you are right, BUT if she just signed up to do her own show and then changed her mind, then ANYBODY should request and be granted a DMCA take down notice. Anybody disputing this will end up like those guys from GirlsDoPorn... in jail. Especcially in today's MeToo environment.

I would say to those dealing with these: "To be judicious not stupid and let the dead dogs lie".

yes they can remove 'allow network promotion' found in their profile > settings & privacy

I got a letter from a lawyer over same sort of thing not even hosted had to explain to the lawyer that the site that hosts it shares it and can show why others are using it all the way down to the embed link and asking why they uploaded to offer an embed link if they don't want it used.

Do file a counter notice:

- Tick the box: "I am not the copyright owner but I am authorized to use this content".
