Producing is much different than downloading. I don't see what the problem is.

Producing, purchasing, distributing, and downloading are all different things.
I've had CP email spams sent to me, and I'm sure the images probably downloaded onto my computer's cache on the hard drive. Should I be charged and registered as a sex offender along with the other 10 million people that got sent that email spam? |

What things in society are considered so depraved that even association with such acts or events is considered unlawful. I mean there really arent many things where you arent exactly commiting a true crime for which you can get jail time, but viewing child pornography is one such thing and for good cause, anyone getting off on such shit certainly has one or two screws up in his head loose and needs some sort of help. Maybe jail isnt always the answer but then again letting someone go with just a slap on the wrist isn't exactly a deterent.
