Why open affilate programs will close soon...
 
As a business you are responsible for the actions of your independent contractors *if* you do not show discretion in selecting them... Didn't some program recently lose $4mill because a renegade affiliate spammed some newsgroups?

To me this says -- "Goodbye open affiliate programs..." if it means being responsible for one anonymous prick that will take you down bigtime.

I'd like to hear the opinion of a lawyer on this with regards specifically to affiliate programs...

My affil proggies have never been open. My only affiliates are a trusted few who I trained myself.

Interestingly, we had better results finding good affiliates when we our program was by invitation/application as opposed to open enrollment.

Frankly, I've been surprised at how easy it is to become a "reseller" for most...if not all...major programs.

This should be a lesson for all the affiliate programs out there..

Most non adult affiliate programs are MUCH harder to join and I was surprised when I started in adult that I could join any I applied for and instantly too.
